STUDENT VISA AND AOS AFTER MARRIAGE

Hello! Question here... I don't think this is the only case, there must be some more people in the same situation:

A friend of mine from Venezuela has been to the US for 2 years with a student visa (she goes to college here) but she got married 2 weeks ago with an American citizen. They asked me how I have been doing with my AOS. My case is very different since I arrived with a K-1 visa. So I don't know what to answer to her, and they don't have a clue about where to start. Which should be the first steps for them to take?

If she wants to immigrate your friend and her husband can start by looking at the Getting Green Cards section of the USCIS web site. In short, he submits and I-130 petition for her and she concurrently submits an I-485 application to adjust status.

Specifically what type is her visa? The alphameric designation.

Hi Yodrak! Thanks for replying... I think the student visa is F-1. But she's already here, so how could she do? Would she have to leave the country and start a whole K-3 process???

She can apply for I-130 and AOS while she is here.. there are a few other people on the board (kezzie, clmarsh and jayjay who didn't go the k1/3 route and adjusted from here) I didn't do it that way but i'm sure there is plenty of info here somewhere!

My husband is also on F-1 (student visa). As far as I know, the only thing that's different is that they'll need to file the I-130, petition for alien relative, along with the I-485 (AOS). My husband is not leaving the country. His visa has not yet expired, and we are already in the process of AOS. I would probably advise, though, that your friend file the AOS before her visa expires. Just in case! :)
