Today I have spent hours reading messages regarding the IMBRA and the cancelled interviews. It seems pretty clear to me that the overseas Consular Sections are not really clear about this and I am sure it will be sorted out. It does not make any sense to return thousands of petitions with a NOA2 date of March 6 or after. That would cause caos!! All they would need to do is send the petitioner a RFE to obtain a criminal investigation and to send that to the U.S. Embassy so they have it on file when you have your interview.

Reading the legal aspects of the law, its is clear that it is effective March 6, 2006 but not for K1 petitions that were sent before that date. So common sense says that any NOA1 of March 6 or after would fall under this new regulation. All those at the Texas, California and Nebraska USCIS offices do not have their NOA2 yet since it takes 80-90 days. So they cannot have an interview date yet. Those applications will likely get RFE's for the new IMBRA law. I think those who filed via Vermont USCIS will have some issues since this is a very fast USCIS center and most NOA1's after March 6 likely already have a NOA2 and some may have been sent overseas. Those are the ones I believe are being questioned. Anyways, this is my two cents. Hope it helps some of you with concerns.
