Hi hope anybody can help me, My husband and I is already separated he make our divorce very simple that nothing to do with each other he said so that the divorce will be final very fast, and I need to remove the conditions of my greencard next year june 11, 2009, I got only the following as an evidence of our marrieage.

Tax returns 2007-2008

Credit cards, Master card, American Express, Discover card, and Sams club card

Photos of us

Cards from the family members

Deed of sale of our house in Philippines

He did not put my name on his house because his ex-wife is still the one listed their and he is been trying to take her name out but it's late because we are divorce and he never put me on any insurance like car insurance other, what else i can do or some evidence to collect that we really marry in good faith, We decided to it this way because, I cannot stay with him, He dont like us to have children and all he want us to do is travelling until the rest of our lives, he is not willing to give up his life just for a child, and I must be always with him 24 hours a day, I am not allowed to get out from the house even just in the store without him or without anybody with me like a bodyguard, Hope anybody can help me, what other evidence I can collect, Do you think those eveidences I have above is enough for lifting conditions. Hope anybody can help me here, Thank you.

Your evidence is fairly good. If they refuse it, you might have enough reason to file a VAWA Petition: "He would not let me out of the house without him, he insisted on always being with me, he would not let me have other friends, he threatened me if I did not do what he said, he kept moving us around and would not tell me were we were going, he would have sex with me when I was not interested and had told him no, he refused to let me have a kid, he lied to me." blah blah blah. Your evidence of selling your house, your financial evidence - credit cards (whoa that is a lot of credit cards! you should not have more than two!) - and photographs of oyu are often enough.

I am not a lawyer. I am familiar with the immigration process, but any questions I answer are not advice or represented as being true for your situation in any form or manner. I am not liable if you read what I have written and act upon it. Do your own research, ask an attorney for assistance, and make up your own mind. Nevertheless, I may attempt to answer questions from time to time to give you an idea of what to search for in finding out your answer.

I think you are fine, at least have several financial stuff...and remember to put a cover letter explaining the cause of divorce. If you can get affidavit of friends of yours that met him will be good.

If the Deed of the house in the Philipines is not in English remember to translated.

In the back of the cards remember to put ...who is who and where.

Didn't you file taxes as married in 2006 or you still weren't married or you did not have a SSN?

Well the WAVA requires more than she said/he said statements.

But well, yes you most file as soon as your divorce final your I-751.

Is there a way to get something that states that you lived in that same place even your name is not in there? Like the association management they should have you in their records, they can give you a letter stating that you lived there. Junk mail or whatever other mail that have your name or his with same address...

Good luck!!!

No, only the holiday cards that was sent to us by the other family members and some notification from USCIS when I am adjusting my status, I have no bills also stating with both of our names like energy bills, water bills, phone bills I might have, Yes the house in Philippines is in enghlish, What other evidence I can collect? No e-mails from any friends, if they do they just address it to him and none of them write to me, we have no bank statements stating in both of our names, we have in philippines but the bank shut it down because we never use it for over a year it is an ATM.

Here is the only file I got

Tax return 2007-2008 ( both in our names )

Photos of us together

Credit cards, Master card, American Express, Discover card, Sams Card (all in my name or married name with him)

Greeting cards or Holiday cards from the family member, ( some in both names and some just mine)

Marriage certificate ( I even lost it, dont know where it is now)

My greencard and will expire june 11, 2009

Drivers license ( my name or married name)

SSN no. ( my name or married name)

My problem also because he has all the people who take care of everything, the bookeeper is the one who filed and keep all those things like the Tax return, and credit cards statement I dont know how to get them, it is in his company and his general manager is the one who knows everything and I dont know where those papers yet I need to get them but I know about those Tax return with both our names because he showed it to me all i need to do now is to have a copy of those statements right. Thanks for the reply... God Bless...

You can get a copy of your marriage certificate by going to your City records office.

Also, you can request a copy of your federal tax return for 2006 (if you filed jointly) from the Internal Revenue Service. This link gives information on how to do that: http://www.irs.gov/taxtopics/tc156.html.

I recommend you get a copy of your credit report and it will list any credit accounts that you have. Then you can contact the credit card company and ask for a copy of a statement. http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre34.shtm
