Co-sponsor filed Joint taxes

Hey guys,

Here is my new dilemma:

My fiance has her interview on July 7th for her K1 visa, and my mother who is my co-sponsor just informed me that she files taxes jointly with my dad.

My mom is the co-sponsor, but because they file taxes together, does that mean I need to have an affidavit of support from my mom, my dad, and me, for a total of THREE affidavits that need to be provided to the embassy?

Also, does that mean I also need to provide financial information from my dad as well, such as letter from employer, w2's, tax returns, etc?

I just don't understand why that would be necessary as my mother is the co-sponsor, not my dad.

Also, they filed for an extension for their 2007 taxes, however I am able to provide my mother's tax returns, etc. for 2004, 2005 and 2006, as well as her W2's from this current year. Does the embassy expect returns from this current year or only last year with this years w2's?

Thanks guys, and basically I am sort of flipping out because the interview is in less than 3 weeks.

10-27-08: Medical Exam

10-28-08: Interview! Approved!

12-20-08: U.S. Entry (POE Chicago)

1-2-09: Marriage

1-27-09: AOS package sent

2-3-09: NOA1 for I-485, I-765, and I-131

2-9-09: RFE received (need more income info. for household member)

2-24-09: Biometrics appoinment

2-25-09: RFE information sent back

If you search the forums you will find the information you need.

Your mother can be your joint sponsor alone as long as she meets the criteria and you can send in her income tax returns regardless of the fact that she files jointly with your father.

As far as the extension goes... you should contact the embassy your fiance will be going through to explain the extension and find out what documentation you will need.

Please don't flip out on us! You are so close! I am trying to find out if the Bangkok Embassy will look at the whole picture regarding the I-134, etc. I would not think that you would need anything from your Dad. I have no plans to sign or send anything if my husband ends up co-sponsoring, and we hold everything jointly except for IRAs and his job. Of course that isn't too comforting to you, as in the same breath I'd advise you to check directly with the embassy, and I know they are not answering any email, at least for today. Common sense tells me your Mom's W2s and a copy of their extension request would suffice for 2007, but I don't have any knowledge of how much they stick to their own letter of the law and how much common sense they exercise at the Bangkok embassy. It sounds like they are fairly cordial, but I do not want to take anything for granted. The unknowns are what get to all of in this process. There are just too many of them.

Thai family, yea about the US embassy not responding to emails, I don't know what's going on with that.

My fiance had his interview recently in Brazil. I had my father as a co-sponsor and he files his taxes jointly with my mother. I gave them just my father´s affidavit and information thinking they did not need my mother´s, but they did ask for an affidavit for her as well. I luckily did have one from her just in case, so they do ask for it sometimes. It may be different there, but they did ask for it in my fiance´s interview. So it might be best to have one for you, your mother and your father, just in case.

I do not know about the filing extension for this year, but I know what you mean that the embassy never answers emails. It is very frustrating.
