Okay, i have already had my 1st wedding anniversary. By the time USCIS is finished with us, i am guessing that it's going to another 7 or 8 months, if we are lucky :unsure: Won't they just go ahead and issue the 10 year visa then? I mean we would have been almost married for 2 years by then. It just doesn't make any sense to issue a 2 year greencard then.

I know its' USCIS and they dont' actually work smart nor hard lol but geeze, i think this is just simple common sense. :whistle: . Does anyone know?

Here is what happens;

If your interview for the CR-1 before 2nd wedding anniversary, the resulting visa is coded CR-1, HOWEVER, if you hold and then enter the USA AFTER your second wedding anniversary, the resulting green-card should be UN-Conditional 10 year card.

If your interview happens after 2nd wedding anniversary, then the visa should be coded IR-1 and the resulting green-card will be the 10 year one.

Is now a US Citizen immigration completed Jan 12, 2012.

huh... that is good, I thought that once they approved you, it did not matter when you entered, it was from the time you got approved for the green card that determined what visa it is. That is good news

I-130 Timeline:

12-11-2007- Married my Love

02-08-2008- CSC receives I-130

02-11-2008- Received Hardcopy NOA1

08-14-2008- Approved!!! 216 days...

08-21-2008- NOA2 Hardcopy received

08-27-2008- NVC Receives file, NVC Case Number issued

09-05-2008- AOS Fee Bill and DS-3032 Generated

09-06-2008- E-mailed DS-3032 to NVC

09-11-2008- Received Hardcopy of DS-3032 and AOS Fee Bill

09-15-2008- Mailed Hardcopy of DS-3032

09-16-2008- Paid $70 AOS fee online

09-17-2008- Received E-mail confirming the DS-3032 Agent

09-17-2008- Printed Coversheet for AOS paperwork

09-17-2008- IV Bill Invoiced

12-16-2008- Sent I-864 EZ to NVC

Nope, Residency status is determined by when you enter the USA.

Keep in mind a CR-1 visa has only a limited term of validity, so you need to use it before it expires, which may be before 2nd wedding anniversary.

we have been married for 6 months, and we are still waiting for the I-130 to be approved. The way USCIS is moving, we could be on our 5th wedding anniversary before he gets his interview....
