Calling USCIS to see if it's the NOA1 or NOA2 date after March 6th

I don't know if any of you other ME/NA ladies and gentlemen have called already but Jordanianprincess and I are both calling so hopefully we'll have an answer to whether files are being sent back to the US for further review with an NOA1 or NOA2 date after March 6th. Hopefully it's for the NOA1 date! Keep your fingers crossed.

Oct 5, 2006 - Interview SUCCESS

Oct 12, 2006 - Called to pick up visa tomorrow!

Oct. 16, 2006 VISA IN HAND!

Dec. 24, 2006 - Said arrives in NOLA, just in time for the holidaze!

Dec. 31, 2006 - OUR WEDDING!!! Ringing in a New Year as husband & wife!

Jan 8, 2007 - applied for SSN

Jan 15, 2007 - recieved SSN

Feb 6, 2007 - checks cashed for AOS/EAD/AP - YAY!

Feb 8, 2007 - NOA1 on AOS/EAD/AP

Feb 14, 07 - touched EAD/AP

March 8, 07 - Biometrics appt in NOLA

April 17, 07 - AP approved

April 19, 07 - EAD approved

Well I just got disconnected but we only got as far as for the woman to tell me she didn't know what I was talking about which is pretty reassuring... back on hold so hopefully this time we'll get an answer.

Exactly what do you mean by calling the USCIS to ask if petitions are being returned to the United States for further review with an NOA1 or NOA2 date? I have quite alot of information on petitions returned for further review. What information are you looking for in respect to petitions returned to the US for further review?

Well some people on VJ are having their petitions sent back to the US for further checks on the US citizen to make sure they have no criminal record etc. They are saying this went into affect on March 6, 2006, but we didn't know if your NOA2 was after this date if it is going to affect us. I called the USCIS to try to get more information and I was transfered several times, talked to 4 people, including an immigration officer who didn't know anything but he said that since we are already approved he can't see why this would affect us.

Here is the website that Jordanianprincess sent to me which explains IMBRA. I hope it's more clear now.

The immigration officer I talked to was not at all familiar with the law. I guess it has not come down to their level yet. From reading other peoples posts it appears to be NOA 1 on or after March 6 that are being recalled.

This law was created to protect women from domestic violence but the way they wrote it, it's gender neutral. So it can affect us. I think this mostly affects people that had an NOA1 on or after March 6 and have already recieved NOA 2. If you have not recieved NOA 2, I don't think you will be affected by a recall but they said they will be sending RFE's for more information , i.e. crimial records, etc.

The other major thing is that if you have any kind of criminal backround, record, domestic violence, it will be presented to the beneficiary at the time of interview in his/her native language.

Anyone else have any takes on the link Sarah provided?

I believe this applies to male petitioners/female beneficiaries.

It's gender neutral and can affect anyone, its not realistic, but it can affect us women too.

JP, that is exactly how I understood it as well. If the NOA1 date was on or after March 6th, already received the NOA2 and on to NVC or Embassy, then they are recalling petitions back to USCIS. BUT if you have not received an NOA2 approval yet it will just cause further delays for the additional security checks. Am I misunderstanding anything??

Actually Noura, I thnk your good since you just got NOA1, it won't delay you much. But for those that had interviews and their interviews got cancelled. It really sucks.

I'm waiting to get more clarification on this from my attorney, I will let you all know. I read the entire law and thats exactly what I gathered from it.

Ok, now I understand. I had no idea this is what you were referring to. I wish I had more information on it, but I don't.

It will be interesting to read up on it and see how this would affect any cases which have been reaffirmed after return to the USCIS from the consulate. If there is any affect at all, etc.

I pray it does not affect any of your petitions currently waiting...insh'allah.

Arrived in the US - May 27, 2006 (our IR-1 visa journey was 2 years and 2 months long)
