Hi to everyone who is helping us here and giving us answers to questions!!!

First of all i have couple questions,....so i will be thankfull for advice from anyone,..!!

1.question for AOS I-864,..... (I am petitoner)I do not meet Poverty guidelines for 2008,and i want my father to help me out in my case so,.my question is ..should my father fill out AOS I-864 also or just I-864A????,, with my comleted AOS I-864,,????

2.question for pay stubs and employee letter,..I do have employer letter and evidence for my tax that i did pay tax for recent three years,.. but problem is that i do not have pay stubs for last recent months,...so what should i do,..??

If i send them my AOS I-864 completed without pay stubs,...Are they going to make a problem about pay stubs and send me RFE as a evidence for pay stubs,..PLEASE I NEED ADVICE ON THAT ONE AND ABOVE QUESTION ALSO,.. I have all documents completed for AOS I-864 and DS-230 just need to send them out to NVC,..BUT i dont know what to do with those evidence above PLEASE ADVICE ME FROM YOUR EXPIRIENCE THANKS,...

Concerning the co sponser im sorry i cant help but may be someone else can....

But concerning the pay stubs dont worry u dont have to send them... its optional.... u can send either... since u have employee letter thats enuff n u ll b fine

If you have a look at the I-864A you will see that it has the heading:

I-864A, Contract Between

Sponsor and Household Member

If your Father is a member of your household, as defined on page 1 of the form, then he should fill out the I-864A.

If he is not, he should use the I-864.

So it is one or the other, never both.

Yes he is a member of household,we live together at same house,..so he needs to fill out I-864A with mine I-864 and send them together,..? Am I corect,..?

No need 2008 yet. Just 2007. 2008 doesn't come into play until 2009.

I can't say they won't ask for them - they may or they may not, however, since you don't meet the poverty guidelines (currently) anyway - they aren't going to really add anything to your I-864. As you are going to be using a co-sponsor, then, as HisLittleMasriyah mentioned, just get your employer letter. Chances are they won't ask for your pay stubs, plus, you don't have them so there is nothing to be done on that front, unless you can get a copy somehow you will just have to submit your paperwork without them.

(2) Job Letters and Proof of Income.

Pay stub(s) showing income for the most recent 6 months and letters from all current employers are no longer required as initial evidence. The applicant, however, may submit either or both of these items (1) in response to a request for additional evidence (RFE), or (2) with a Form I-864 if the applicant believes doing so would help establish that the sponsor meets the governing income/assets threshold. If submitted, letters from current employers should show dates of employment, the nature of the job, wa ges or salary earned, number of hours/weeks worked, and prospects for future employment and advancement. It should be sufficient for the employer to say that the employment is of indefinite duration or words of similar effect. Promises of future employment are not required. link
