Good morning... I have a question. I was at work yesterday and spoke with a woman who's family is from the MENA. She asked about my situation and I told her I was married to a MENA and that we were working on his K3. I got the tsk tsk.... "EVERYONE knows you don't marry them if you want them to come over... you go do the fiance' visa, much faster"

Why is that??? I had to undergo 3 judges and one police interrogation for an hour and a half to marry my husband why now is it harder to get him home with me than not having married him???

I have noticed K1 are faster can someone tell me why this is?????

Thank you in advance

A K1 is not a faster way to get permanent resident status in the USA than an immigrant visa is. It is a faster way to be reunited with a fiance because no I-130 immigrant visa petition is needed and because you can file anytime after you've met in person. No need to wait until after you arrange to marry and have a marriage certificate.

When things progress normally, an I-129F for a fiance(e) and one for a spouse will have similar timelines from USCIS receipt until visa interview but the one for the fiance can be filed sooner after the decision to marry than one for a spouse can even if only by the space of time one waits for the I-130 notice of action. However, a few have recently been successful filing both the I-130 and I-129F together in the same package, thereby mitigating that extra time.

I feel like that when we put our paperwork in... I130 vs. I129f the latter is approved faster by several months?? not just a couple... married couples apart for over a year while finace's reunited in months...as early as 4 even but not if you're married. Am I off base here and slanted in my views???

For the past 10 months or so it does seem that cases requiring an I-130 have taken longer to get through the service centers but that's a temporary result I think is due to poor implementation of the new policy to put the I-130 and I-129F for spouse together for adjudication.

An immigrant visa for spouse has always taken longer but has sped up lately. Remember, USCIS is not the US Couples Reunification Service. It's about immigration. A visa is just a part of the immigration process. Permanent Resident Status and potential later Citizenship is the prime focus of USCIS.

I understand that (and thank you btw you're the only one posting back lol) I just found a couple from the same consulate that got their interview in 4 months for a k1.... I can't say anyone that has gotten their paperwork in for a k3 or CR1 only waited 4 months for their interview ? Again am I off base? You are right USCIS is doing their job but at the same time how is it that other countries only take 1 to 2 months but this country our country (don't get me wrong I am indeed very patriotic) takes so much longer and than what appears very preferential?

Anyway, no worries just a vent and a frustration.. got my NAO1 on my I129F (went with the K3 since they seem to be going faster now) One month down 11 more to go... if i had only not married him than only 3 to go.... (see my point?)

Your stated goal was to understand something, so that's what I addressed. Each case is different, so I cannot explain why one case takes more or less time than another from the same country in a way anybody waiting longer will like. I hope you've gained some knowledge whether you gained satisfaction or not.
