Misrepresentation - Where does this come from?

Hi all,

My wife was accused of misrepresentation somewhere.

She was given the I-601 form when denied her visa at the visa interview at the Rio de Janeiro Consulate.

Can this charge arise from the actual visa interview itself?

My wife says that during her entire interview the interviewer did not believe our marraige was real. Just a ploy to get her into the US.

Not so! We are both sooo broken hearted, depressed.

It's been but 4 days since the denial, but seems like an eternity. Can't think of anything else.

I'm sure most on here know exactly what I mean.

I am truly so sorry for what happened. I know how you are feeling as my husband has been on security checks after his interview for the past 9 months. Ya and each day feels like eternity as well. There are people who have been waiting much longer and I only pray that they get clearance.

So there are two kinds of main delays after interview, that is security checks of you pass the interview (mainly in middle eastern nations) and then the one that sends case back to US for misrepresentation. I am sure you had substantial evidence for your relationship, in this case, can you contact the consulate and make an urgent request for a 2nd interview or contact your congressmen to not let it get into processing here so that it stays at the consulate? you must try these things, some peole have been able to get their cases to not go through the US.

Again I truly feel your pain right now. Please read the threads here that will tell you the best actions to take when the case is denied temporarily due to relationship validity. I know you know your case is genuine and your hearts must be broken because the consulate did not respect this honest relationship. but do not dispair, we all go through many hurdles in the visa journey and if you can get this turned around and keep it at the consulate level, it may not be such a long delay.

Can she contact the consulate to find the exact reason for denial?

11/2004 - Met in Brazil

09/2006 - Apply for K1

03/2007 - K1 approved

04/2007 - Apply for AOS & EAD

07/2007 - EAD approved

01/2008 - Conditional Residency approved

11/2009 - Apply to remove conditions

02/2010 - Permanent Residency approved

11/2010 - Apply for Citizenship

03/2011 - Citizenship approved

07/2011 - Moved back to Brazil
