Question: on the status page, will they tell you you've been mailed an RFE or do you have to wait to find out? Our case has been touched twice in recent days, but now I wonder if it could just be an RFE.

Hey Symbiosis - Here is what the message looks like. I sure hope this Isn't an RFE for you. Just keep in mind that usually when you are touched this late in the game it is the adjudicator processing your case for either an approval, RFE, (or denial but we won't go there!).

Can you tell me if you used an attorney?

No, still says pending. I was just wondering if the touches could be unnoted RFEs. Yes, I do have an immigration attorney and have had no problems at all. I am really sorry to hear you've had troubles.

If you have an useless attornet, i dont blame you. We had an attorney and she didnt do much, well she didnt do anyhting!!!. She gave us the forms we needed to fill out (I knew them already since I checked them here). If they send you an RFE, your attorney will receive one and you will receive another copy. If you receive the NOA2, your attorney and you will receive one copy. So you can do your things from now on. Just read the steps to follow and good luck!!!!!! it's better to do your things yourselves!!!!

Can someone please tell me if an RFE is sent to the petitioner as well as your attorney? If so can i be the one to send it back rather than our attorney?

I don't know if they send you one or not. I would think they are expecting to send and receive everything through your attorney. I saw your earlier post about removing the attorney. I don't know what it takes to get the attorney off the case, and that might even muck things up a bit, but there's no reason you can't find out from the attorney what the RFE was and what you need to satisfy it. Then you can supply the attorney with whatever that might be, and maybe specify that you want to have it sent back UPS Overnight or something and you want the tracking number--even if you pay the fee for it. They ought to be able to do at least that for you.

From what I've read, approvals are just a day or two after USCIS receives the information back, so you're probaby right on the edge. That tracking number will give you some piece of mind knowing that they actually got it, and not wondering if the attorney has even got it out the door yet.

As distasteful as it is, it might be better to take the attorney off the case after you have your approval, rather than risk further delay while USCIS tries to get your case adjusted mid-stream, unless USCIS can assure you that it is no problem, but I didn't get that from your other post. LoL I think that after NOA2, it all pretty much switches focus to the beneficiary, so the attorney is probably mostly out of the picture anyway at that point.

I hope he will cooperate and get out of your way. The process is hard enough having to deal with people who know what they are doing, but don't care. You really don't need to be dealing with people who do not know and do not care.

I hope you can get this quickly resolved and get onto the next phase. B)

If you have an useless attornet, i dont blame you. We had an attorney and she didnt do much, well she didnt do anyhting!!!. She gave us the forms we needed to fill out (I knew them already since I checked them here). If they send you an RFE, your attorney will receive one and you will receive another copy. If you receive the NOA2, your attorney and you will receive one copy. So you can do your things from now on. Hey thanks so much for the info! You are right we don't want him doing anything else to our case if we can keep from it. i wanna ask ya make sure i understand correct. You guys had an attorney, was issued an RFE, and you and the attorney both received a copy of it? If so did you return it yourselves? I've been trying to ask someone who went through this if both received a copy and if they returned themselves so thanks so much! I'll be looking forward to your reply. Best of luck to you.

thanks mike yep i got your reply sorry i got side tracked with work and didnt send you a reply after that, thanks for the support i just checked nothing today yet as far as touches,

Radz is doing great now the doctor gave her some medicines and within a day she was doing much better. Good luck you getting your rfe returned, as soon as you find out what was wrong you can send it back and they will get right back on your case.

Let me explain this. We had an attorney, thank God we didnt receive an RFE but my fiance and the attorney received the NOA1 and the NOA2. However, when he received the NOA2, we decided to continue ourselves. I checked the following steps and helped my fiance with the affidavit of support. Of course, she didnt tell him about it. She also told him she would receive the package 3. I received it, found out about my interview, my medical exam, etc. Three days before my interview, the attorney called my fiacne and told him that my interview was going to be on October 10th, and i needed to go for my medical exam ???????......We havent heard anyhting from her since that day. She didnt even called my fiance to find out if i was approved or not. But as soon as i get to New York, we are going to talk to her and we are going to ask for the refund. I hope we can get it...

Hey Steve - Ok I'm glad to hear Radz is alright now. Food poisoning is a scary thing for sure so let her know we are glad shes OK. I sure hope you hear something this week, i have a good feeling that you will ;) .

As for us I spoke to the attorney and he did receive the RFE today and it was for my missing passport photo which I sent to him so i guess he fumbled it.

So he said that he sent it to me overnight mail today and it is ok that we send it back so, that's a big relief! I've already gotten new ones today and I'm ready to mail it out tomorrow just as soon as I receive it. I'm going to write on the outside of the envelope "RFE reply enclosed" and send it express overnight service so I can track it to know it was received and hopefully it will get picked up and approved quickly.

I really really hope everyone has a good week and they approve all us June filers! Good luck lets stay strong and positive!
