I filled for my husband the k3 who is Brazilian and resides in Brazil, the K3 was approved, and were now just waiting for him to receive a letter regarding some medical things that he will need done and the interview date. I´m here in Brazil with him since Nov 07, and now I´m almost 7 months pregnant and I want to go home to the US to have the baby. But I want my husband to go with me. Do you know if there is anything that I can do so that can happen??? I can only travel until 8 months.

Has the K3 already gone through the NVC? Havey ou done the Consular interview yet?

Contact the Consulate & NVC to find out what is going on and if things can be sped up. Request an emergency expedite due to your impending birth and the requirement that you not fly after 8 months pregnant.

It has gone through the NVC, but we have not done the interview yet...I´m going to contact them, thank you

Sorry, you can't speed up the process because you're pregnant. Maybe you can make an appointment at the Embassy and try, but it is not an official reason or procedure to rush the case. Would you consider having the baby in Brazil?

Not really here things are very complicated when it comes to medical insurance, I have it but once you do it u have to wait 1 year before the pay for the child birth, and I did it when i became pregnant so they won´t pay.

I would doubt very much that you will be able to speed your case up due to the pregnancy.

You will most likely just have to return to the U.S. to have the baby and hope that your husband will have his visa by then.

I don't know how difficult it is to get a visitor's visa in Brazil, but is that an option for him?

I dont have any advice on how to get your husband here for the baby's birth... I think its very hard to get the embassy to make exceptions.

However, in regards to travelling pregnant, check with whatever airline you plan to travel with. Some airlines request a doctors certificate dated within 72 hours of the flight, to certify you are fit to travel.

Maybe if you speak to the embassy they will be able to issue you fiance a visitors visa so that he can travel to the US for the birth and then return for his interview afterwards. He would have to show very strong intent that he was going to return to Brazil and the fact that his wife and new born child will be in the US isn't going to help his case. I would also be very surprised if they allow you any kind of expedite because of your impending pregnancy, many women give birth without their partners everyday and your fiance's situation isn't stopping you from returning home. The only option you may have is expediting on grounds of financial hardship however I don't know if the embassy in Brazil will except expedites at this stage anyway. Your best option is talking to them I guess and seeing how flexible they are willing to be.

Gisele I actually think you should the Rio de JAneiro embassy, they might understand your situation and help you. You will also have to wait more because if you have your baby in brazil you will have to wait more to go back to US, procede with papers and shots, doctor appointment that the baby will have to wait. And if it left the NVC already they should tell you if the got your papers there and may tell you the itnerview date before you get the pack.
