Hello everyone,

My Fiance is currently with me in Canada and is staying with me while we file for the K1 Visa Process. He is the American Citizen and we will be filing for myself, and here is the question:

I'm going to begin figuring out all the bits and pieces required to complete this process, as far as times we have met, and occasions when we have travelled to be together, he arrived here on May 17th, and plans on staying for a few months at least.

The leaving date has not been decided as of yet, so when filing for this visa should we include a ticket showing what date he plans to leave? This would be to prove that we aren't going to overstay his visit, but since we're not sure when he's leaving yet (just that he will leave before the date would become an overstay) can i just write this in the letter and include the fact that he's not going to overstay?

could this come back as trouble down the road, does he have to have a leave date included (a ticket purchased online etc) to prove that he won't be overstaying, or will they take my word for it as has been proven on previous trips when we visited and did not overstay, and just say that we're not entirely sure on his leave date right now but it will be before the required date. (i'll have to do the math)

ps i do realize that the number of days for all of our visits counts towards the total for the overstay, and not just this one visit.

he has been in canada for three weeks previously, so we may make his stay about four months this time to make sure it's not an overstay.

thanks so much and this process would maybe be close to impossible without this forum, i've been reading it at work every day

USCIS is not concerned with how long the U.S. citizen is out of the U.S. They are only concerned with how long a non-U.S. citizen spends in the U.S.

For proof of having met, and ongoing relationship, you just need some evidence that you have in fact spent time together.
