WOW...this is very horrible. My NOA1 is Feb 7,2006. NOA2 is 4-25-2006. Furthermore, this is my 2nd K1. Is this going to effect me? I am very worrying....Am I going to be ok? Please, help.

Unfortunately, this new law looks at people who have filed more than 1 K-1 in the last 2 years. From what I read, this "could" cause them to deny your approval.

Hmmm, Hi all

I was looking at all 3 peoples timeline who got a IMB Recall.

Out of this Palak had her NOA1 way before March 6.

and this other person also had NOA1 before March 6.

BUT ALL 3 had NOA2 after March 6..

So still confused..where the law will exactly cut-off.

Palak, have u talked to the EMBASSY YET.

All I can tell you folks is what the guy in the London consulate told me.

He said this was a world-wide recall, but it is based on the RECEIPT

NOTICE date (NOA1), and NOT the approval notice (NOA2)

If your NOA1 is on or after March 6th, IMBRA affects you.

If your NOA2 is on or after March 6th, and your NOA1 is before

March 6th, IMBRA doesn't affect you.

The dude at the embassy seemed to be indicating that this was a

Department of Homeland Security oversight/screw up.

I-751 - Removal of Conditions

05-01-2009 - I-751 Packet Mailed to CSC via USPS Express Mail

05-02-2009 - USPS tried to deliver. Nobody home@CSC. PS Form 3849 left for CSC to reschedule delivery.

05-04-2009 - I-751 Delivered to CSC@6:28am. Signed for by "V SEMEGI".

05-04-2009 - NOA1 Receipt Date. Same day as delivery - Wow!

05-14-2009 - Check cashed

05-16-2009 - Conditional Green Card expires

05-18-2009 - NOA1 Arrives in the mail

06-22-2009 - Biometrics notice arrives in the mail

07-06-2009 - Biometrics appointment @ 1pm

are they suppose to call you to reschedule your appointment? or can you call them? my fiance called and they dont tell him anything. i just want a very very early date like tomorrow. i dont wanna wait for them to call my fiance. we missed our original appointment date which was suppose to be today at 9am thanks to the stupid recall.

This law was passed by both houses of Congress, and sent to the White House for signature which Mr Bush did. This lasw was passed because they was a definite need as was revealed by Congressional hearings on the subject. Do you realize how many women from less developed countries have been victimized by sexual predators who had their petitions approved because there was no law that allowed the USCIS to checkout the backgrouds of these characters and notify potential spouses that their fiancee is a convicted stalker, child molester, registered sex offender, etc.

I think this is one of the better laws that has been passed regarding immigration in recent years. You want these ppl identified and put a stop to their sick behavior.

Sorry for those who will face a slight delay in the approval of their petitions, but I think it is really worth the wait. If you are a potential female fiancee immigrant, I would think that you would like to know before its too late that you are engaged to a registered sex offender.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

If his case is not affected, they will get in touch with him. Most likely,

they will mail him out a new appointment. I'm kinda getting the feeling

that I was a special case because of my circumstances (fiancee is

pregnant), so that's why I got a phone call.

Tell your man to try and be patient. London Embassy is a decent place,

so they're probably working through who's affected, who's not, and who

needs their appointment rescheduled. Give them a bit of time to get sorted

out themselves! :thumbs:

Slight delay!!! I highly doubt that. :angry:

They can get a report from the FBI national crime base in minutes. Any cop in the US can get your criminal history while they have you stopped for speeding.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

Well, there are many scammers and the number of female scammers outweighs the male ones.

Talking about scammers -- not abusers -- so the law doesn't even take care of the most widely spread problem.

The problem of gravity it addressed that being personal abuse, not the one of scamming, fraud.

Oh well ... who know how long it will take ... wonder how many Petitions they will get screwed up and take months to years to straighten out!

I'm sorry but shouldn't there be a list of hot spot countries this should apply to? Like the new program that tracks men who frequently visit countries where child sex sales to tourist is a problem? Or at least shouldn't they only send female alien cases back? Not that you guys should have to suffer the longer wait but since this seems to be aimed at women being brought here under false pretenses how does it apply to people like elwintro?

But that would be too simple huh? I'm making a big KISS sign and hanging it outside Congress! :whistle:

11/14/2006 AOS packet made it to 'the box' after being overnighted.

12/02/2006 Paul had biometrics

12/14/2006 AOS Forwarded to CSC AND AP Application approved.

01/17/2007 First touch of 2007 at CSC

01/20/2007 Touched AGAIN (also the 18th) come on...

February: Oops, RFE for a REGISTERED marriage certificate. Oops! Overnighted it.

02/28/2007 Paul gets email letting us know his GREENCARD is on it's way! It's done...for now!

03/09/2007 Paul's greencard arrives. And breathe...

We began with mailing the I-129 in on February 27, 2006 so the whole process took us approx. one year.

Your message prompted me to do a yahoo search on IMB and below is info from a legal website. It is fairly clear. The March 6, 2006 law is for newly filed I-129F petitions. So if your NOAA 1 is anytime from March 6 or after then USCIS will incorporate the IMB background check. You scared me for a minute there. I could not imagine that all embassies worldwide would return approved petitions. All they would need to do is write a letter to each Petitioner and ask them to provide the criminal background checks. It is a procedure that the Petitioner does in compliance to USCIS regulations and they submit that with the I-129. Anyways, I feel relieved now!!!!!

The Immigration Petition Process: Starting on March 06, 2006, any newly filed I-129F petition, which is expected to be revised, will ask the U.S. citizen petitioner to disclose all criminal history and past domestic violence and more. The petition, as before, will ask the petitioner how the couple met. If it was through an IMB on March 06, 2006 or after, Immigration may request information about the IMB and proof whether they completed the compliance requirements.

If however the couple met through an IMB BEFORE March 06, 2006, and thus BEFORE the law's compliance requirements went into effect for the IMB, then it would be expected that, by logic and fairness, the Immigration Officer would apply the standard administrative protocol, "grandfathering", and not inquire further about the IMB and its conduct.

Absolutely. My heart goes out to you because I thought my fiancee and I were

completely and utterly ruined by this. As it turns out, we're not. Neither are you

by the sounds of things. Yes, it may take a day or two for you to hear about

another appointment, but just think how much worse it could've been if your

case was really sent back for security checks.

Really, this is an awful predicament. But try to hang in there...

So why wouldn't they have new I-129F forms then for people filing after March 6th? I used the one on USCIS's website and it doesn't ask for any additional information.

I didn't get the impression that they were changing the form.

"If it was through an IMB on March 06, 2006 or after, Immigration may request information about the IMB and proof whether they completed the compliance requirement." Meaning if the petitioner states on the I 129F that they met through an IMB, then they *may* request information and proof about the compliance. I don't see how that 'proof' could be anything contained on an I 129F.
