This cannot be happening. :crying: We were approved March 8th....we've already spent 9+ months apart....

Love hurts

When you live an ocean away

When you change your sleep schedule to catch a few more moments

When you really need to be held and you have to imagine whilst your partner describes it

When you constantly refresh the USCIS website to see if you're getting any closer

Just received a letter from the consulate in Auckland notifying me of interview cancellation due to IMBRA reprocessing. It tells me to expect a significant delay while they reprocess and suggests I consider having my fiancee come here to marry me so as to proceed with a spousal petition/DCF which they have the authority to approve.

No mention of them paying for travel arrangements though! :)

i have never read of a consulate advising anyone of anything like that... :no:

Depending on the consulate, their own websites even give this information.......that one can marry and file at the consulate (DCF)

The problem is even though we are OKAY, our interviews are getting cancelled due to this misunderstanding. Just as my fiance's got cancelled the day before he was gonna go for it. Now all we can do is wait for the embassy to call him back and reschedule. Made us go thru so much ####### for nothing. Just a waste of time. Now I hate looking at approved cases around our date. Could have been us.

SSN arrived more than a month after.. GRRR!!

November 8, 2006- MARRIED @ San Francisco City Hall

November 21, 2006- Received official marriage certificate

Dec. 19, 2006- sent out AOS

Jan. 3, 2007- Cashed cheques for AOS and EAD

March 15, 2007- AOS interview; APPROVED!!

March 23, 2007- Welcome letter/notice received from mail

March 27, 2007- GREENCARD

Sept 5, 2007 - my first anniversary in the U.S

Jan 30, 2009 - Mailed I-751 removal of conditional residence status

Palak, did they sent u any official letter saying the interview was cancelled, if not than u should have let u fiance go for hte interview..may be they might have called u guys by mistake.

did u callback to check what they are planning to do next.

I regret that you have been unable to obtain information from USCIS regarding your fiance's application. The Embassy has been notified that any individuals affected by the new regulations who wish to obtain information should call USCIS on 1-800-375-5283.

Your fiance's file has now been returned to USCIS via the National Visa Center for additional review to ensure it is compliant with the new regulations. When USCIS have received the file they will contact you, the petitioner, to request you complete additional questionnaires. Once the petition is considered compliant with the new regulations, the file will be returned to the Embassy in London and the Immigrant Visa Unit will resume normal processing.

to which i replied that this law cannot be applied to my case since it came into effect after my receipt date and i asked them if my petition has already been mailed back or if it is still in the building. called nvc but they said it only stops there for a brief moment like an hr so they wouldnt have it in their system. called USCIS and they said if they mailed it to us u would have to wait until we receive it. we do not have any additional info for your case. all i can tell you is wait. so now we dont know where our petition really is! no one gives us clear answers or has any track record of where our case is or has been. i REALLY hope its still in london and they fix this error and reschedule our interview. but who knows =(

In reality this law should only apply to people that MEET after March 6. And at that it should only apply to people that met through a marriage broker. This is all very bizarre. I still think that the embassys are having a panic attack and it will all die down in a few days when they get some direction from the DHS.

Gary...the act is more then just those that met through a marriage broker....that is only part of the act.
