Greetings all,

First I must say it is bittersweet to just find this site. It seems like such a valuable resource, its just a pity I didnt know about it in the beginning of this long process. It could have come in handy.

Ok, now for my concern. I was just notified of our interview date, which is July 2nd. As I was compiling supporting documents, I noticed that my divorce decree states that me and my ex-wife separated on Feb 3, 2007. The potential problem is that me and my fiancee were engaged on Jan 16th, 2007 in Hong Kong. But the fact is that we and my ex-wife actually weer officially separated in late Oct of 2006. I asked my ex-wife why the divorce decree states Feb 3rd. She said that was the date her divorce lawyer said was appropriate because that was the date when I finally and fully moved out of the house (we had a big house and easy to live a separate life in it, and I am very busy in career and not home often anyway, and very busy during that period and lacked the time to get my own place) and got my own place.

Yes, I know the delay seems weird but it is true and our relationship was still cordial with the soon to be ex-wife. Well, now the relationship is not so cordial and she is refusing to write a letter explaining the discrepency of the separation date. Other facts to consider is that my mother is aware of the true situation and is willing to write an letter of explanation. Additionally, the evidence of relationship with my fiancee is what I consider to be very solid. It will be my 10th trip to her when I go with her to the interview in July. We have hundreds of pages of msn chats, emails, and phone bills. I of course have all the receipts, stamps, etc of all my travles to her. And we have many many pictures.

So, now to the question, does anyone have any input into the possibility of this unique situation causing a problem at the interview?

Ordinarily, I would agree that the requirement is that you are free to marry when you file the petition. That's the requirement to get the the petition approved. Where this could bite you is if you made a big issue of a separation date for some reason. Did you make an issue of a your date of engagement in some way?

I've seen a visa delayed by GUZ when the intitial visit and engagement occured before the beneficiary's date of final divorce but many successful when the petitioner wasn't divorced yet. I'm wondering why you are focused on getting a letter from your former wife. What information is missing from you story that is causing you to focus on this? The answer may or may not make a difference.

Facts are cheap...knowing how to use them is precious...

A very good question you asked and I am dumbfounded that I didnt include that in the initial message. No issue has been made of the separation date. BUT an issue was made of the engagement date. I did state in my original 'evolvement of relationship' letter in the initial p1 package that me and fiancee met for the 2nd time in Nov, 2006 (which was our first meeting as an involved couple. The very first meeting was in May of 2006 during a business/government trip of mine in China, and we were totally on a professional level on that trip) and were engaged on january 16th, 2007 on a trip together in hong kong. This whole time it never occured to me that this could be a problem because I knew I was separated with plans for a mutually agreed upon divorce well before the engagement date and even before our first visit together as a couple. But I got concerned yesterday when I saw the date of Feb 3, 2007 in the divorce decree. And at the time I was also skimming through some horror stories on VJ and CFL. So my knee-jerk reaction was to panic, thinking that this could cause a red flag if the VO were to notice me and my fiancee were engaged some 2 weeks before the divorce decree states I was separated from my wife.

I hope this answers your inquiry and allows you to give me a qualified assessment. And to be honest, I was hoping you would reply to this. In the short time I have been browsing this site I have come to appreciate and value your judgement. Many sincere thanks to you.

Dec 20th 2007 - leaves NVC on route to GUZ

March 10th 2008- P3 sent & returned

April 9th 2008- P-4

May 22nd 2008 interview

Filing to Noa -1 -13 days

NOA-1 to NOA-2 - 133 days

NOA-2 to NVC - 22 days

NVC Processing - 7 days

NVC to GUZ - 81 days

In and of itself, it shouldn't be a problem but it is one factor in a common fraud scenario. Other factors in that scenario would be petitioner's low income, a single meeting etc. With ten trips to China, fraud is pretty much ruled out.

GUZ usually takes a closer look at any case with a recent divorce but I think in this case the closer look will be just fine.
