what happens if your fiancee and you get married before the 90 days decided that won't work out. if he stays with da k1 no aos filed, would your citizenship be on the line. and what I'f he leaves back to the origin country. in the future can that person the benneficiary still apply for a visitor visa or anything in the future?

Your citizenship wouldn't be on the line in any event but I can't make heads or tails of what else you're asking. The sentence just isn't put together in a way I can follow.

Your citizenship wouldn't be on the line in any event but I can't make heads or tails of what else you're asking. The sentence just isn't put together in a way I can follow.

I can't make heads or tails out of the original question either, but taking the statements literally, it sounds as if you got married before the 90 days was up, then the marriage for whatever reason wasn't working out, and he/she returned to their home country. If they went back to their country after obtaining a K1, they would have to apply for a different visa to come back...K3 or visitor. Whether or not they would be approved depends on what they try to come back on. But without Advance Parole Document, he/she cannot return to the USA with the original K1 visa. The USC's citizenship is not jeapordized as a result of this. Hope this helps somewhat...

I think she's asking the following:

* If they get married before the 90 days then decide that it will not work, can he stay in America on the K-1 visa?

* If they do not file for the AOS and he stays, will his future citizenship be jeopardized? Or maybe she's asking regarding jeopardizing her own citizenship.

* If he returns to his own country, will he be able to obtain future visas?

Ok If I understand the questions Yamilt is the petitioner. He arrived and they married in 90 days and now they wish to part. After marraige they never filed AOS.

The k1 visa allows an unmarried foreigner to enter the country marry in 90 days and adjust status based on that marriage. You did the first half but it seems you don't intend to complete the second half. Are you intending to divorce ? If you part company so quickly and he does't leave the country the marriage may seem to be an act of fraud and both of you can be in trouble. I am sorry things aren't working out. But you must be careful about what happens next.

we got married before the 90 days, it s not working so i decided to part ways. the aos has not been filed.

but my main question is since he will be leaving before the 90 days of his arrival to the us. in the near future if he decided to get a visa or anyone else decides to petition him as in family or etc, would his chances of getting a visa or etc. ( besides the k1) be jeopardized since he came with the k1 and he had to leave back due to the fact that it just did not work out?

April 21,2008-K-1 visa denied.
June 3,2008-waiver filed at US Consalate in Panama
The interview went well,they told him it will take another 6 months for them to adjudicate the waiver
March 3,2009-US Consulate claims they have no record of our December visit,nor Manuel's interview
March 27,2009-Manuel returned to the consulate for another interrogation(because they forgot about December's interview),and they were really rude !
April 3,2009-US Counsalate asks for more court documents that no longer exist !
June 1,2009-Manuel and I go back to the US consalate AGAIN to give them a letter from the court in Colon along with documents I already gave them last year.I was surprised to see they had two thick files for his case !


June 15,2010-They called Manuel in to take his fingerprints again,still no decision on his case!
June 22,2010-WAIVER APPROVED at 5:00pm
July 19,2010-VISA IN MANUELITO'S HAND at 3:15pm!
July 25,2010-Manuelito arrives at 9:35pm at Logan Intn'l Airport,Boston,MA
August 5,2010-FINALLY MARRIED!!!!!!!!!!!!
August 23,2010-Filed for AOS at the International Institute of RI $1400!

Timeline

If you get married before you get k1 then you will have to file K3 visa if in another country you marry.

If he stays or continues on the K1 path which you already filed, and you get married and do not file for AOS and he leaves the USA and tries to return he is out of status and will be denied entry back into the USA and could be not allowed to re-enter for a very long time. It can happen.

your citizenship is not on the line.

NO you cannot file for a tourist visa or visitor visa in the future if after you file for K1 and get married and then leave the USA without advanced parole or filing for AOS. Once you file for a K1 and it is approved, your tourist visa status is revoked and you are now under the K1 status and have to follow their procedures, which you refer to that 90 day window once they arrive in the USA to get married otherwise they have to return and go back to their country.

If you never marry under K1 and return to your country after the 90 day window, then you can reapply for a tourist visa in future.
