AOS & Affidavit of Support

Hi everybody

Me and my lovely wife are going to file for AOS this month , and i have a question about the affidavit of support, should we fill out a new one, knowing that we used one before i got the visa and i believe that it's in that brown package, and we called the USCIS today to ask about this; the lady said if you already used an affidavit of support before you don't need to file another one for the AOS, so what do you thing ?

i need some opinions and if someone have the same experience it will be very useful to share

Fill out another I-864. You can get by using the same supporting evidence if it is up to date. Otherwise you will need a new employment letter, etc. Make sure to include the 2007 tax forms or transcripts.

With a K1 visa, did you fill out an I-134 or an I-864?

Yes we filled out an I-134

Then follow the instructions on the I-485 and submit an I-864. That's the required binding contract between the sponsor and the US Government. Not the same as the I-134 at all.

More incorrect info from the USCIS MISinformation number!

You don't use a I-134 for AOS. You use the I-864. Can use the same tax returns tho if they aren't out of date yet. My wife used the same G325A with some update. Mainly date she signed.

You need to submit a completed I-864. It will be the first, not another.

i mean we filled an I-134 when i was in my home country to complete the visa process as the consulate requested us to do.

so the I-134 is no longer valid, and we need to file the I-864; that is what you mean , right ?

The I-134 was for the consulate and your K1 visa. The I-864 is the form used for the AOS. They are different forms for different departments and purposes.

Please read the instructions on the I-864 and the VJ Guides. Both instruct you to submit an I-864 with the I-485.

Ok now we now that we need to file that affidavit of support the form I-864 with the AOS packet, but my wife is still a college student and she does not have enough income to support me, and i know that if the main sponsor is not able to support we can have a joint sponsor or the co-sponsor, but every think is OK, we have a joint sponsor it's my father in law.

my question is which form to fill out along with the I-864 , is it the I-864A Contract Between Sponsor and Household Member ? or we need another form

PS : we live with my wife's parents
