Hello all,

I didnt know that I need to file I-864 together with form I-485. I have a problem coz my husband (US Citizen) has just resigned form his work last April. He is currently doing a small business (not registered though) he buys and sells cars.

Legally, he is unemployed but has an outstanding income from last year up to the end of his employment. Will this create a problem if we submit the form I-864 and indicate that he is unemployed? And then find a co-sponsor (my aunt- US Citizen) in order to support my husband's petition. A problem that I see here is that my Aunt has already retired but is receiving good pension from the government, she's got lots of assets, owns lots of cars, a big land in Utah.

Another way that I see as an option is that, do not file the form I-864 now but still file the form I-485 and wait till my husband starts to work again. Im pretty sure he can start a job by July. The reason why he is not been active in going back to work is because we are still enjoying our time together.

Please please help me. I was about to send my AOS package tomorrow but was alarmed by one of the comments I received about the Affidavit of Support. I honestly do not know about thi.

Given your situation I would try to minimize as many hiccups in this process as possible. If your husband doesn't have a job that establishes you both don't fall under the poverty guidelines just have a family member or friend do an I-864 for you.

I suggest you post the cover letter before you submit this packet so we can review it for you.

You must send in the I-864 along with I-485 if you don´t do that your whole packet will be rejected, it´s clearly explained you have to attach this in the instructions. If you have somebody willing to sponsor you I would go both ways, use your husbands tax return last year and your relatives as a joint co-sponsor.

Also, is Income tax returns/W2 from recent tax years will be sufficient enough to prove that he was making a good money until April 2008?

It's perfectly fine and how you're supposed to do it. You husband is your sponsor and he's supposed to fill out and I-864 whether he has enough money too or not. Then an additional sponsor fills one out if necessary.

Well if he's unemployed now the W2s and Tax returns won't make too much of a difference in proving anything, but he's supposed to send them in anyway.

Or it is must for my husband who is filing the petition for me (adjustment of status from B2) to also file an Affidavit of Support to support my Aunt and Uncle?

hi we almost have the same situation, coz my husband don't have job right now coz we both just came back from Phil and he stayed there with me for 4 months... (but now he's about to start a new job) but we mailed the AOS packet already last June 6 ... he checked the unemployed in the 1-864, but we put his income... and we included the w-2 2007 and tax return 2007 and got co-sponsor (his DAd).

Although my husband have continous monthly income from VA and above average, we still get c0-sponsor just in case,,,

I strongly advice get a co-sponsor and write cover letter explaining the situation.. :)

We wrote cover letter for the 1-864 too :)

hi we almost have the same situation, coz my husband don't have job right now coz we both just came back from Phil and he stayed there with me for 4 months... (but now he's about to start a new job) but we mailed the AOS packet already last June 6 ... he checked the unemployed in the 1-864, but we put his income... and we included the w-2 2007 and tax return 2007 and got co-sponsor (his DAd).

Although my husband have continous monthly income from VA and above average, we still get c0-sponsor just in case,,,

I strongly advice get a co-sponsor and write cover letter explaining the situation.. :)

We wrote cover letter for the 1-864 too :)

Fine but in addition to, not instead of. Your spouse must also submit a signed I-864.
