Proving ineligibility to receive SSN

Timeline

In order to get a permit to learn to drive, my wife will need to provide documentation showing that she is not eligible to receive a Social Security Number.

She is here in a K3 visa and will not be eligible, obviously to us, until she gets her EAD.

Does anyone know where among US government websites I might find a statement that would constitute documentation of this fact?

My understanding was going to the social security office and presenting your visa would allow them to supply a document

I had to get one when i got married, to avoid putting a SSN down on paper

some states won't issue the letter if its for a drivers license though, at least back in 2000 they wouldn't

Might be worth paying a visit to your local SSA office to discuss your needs (hell even the DMV may be able to point you in the right direction, it was the courthouse that told me I needed to get a letter from the SSA, which I went and got the next day)

One of the reasons K-3 is less desirable than CR-1 visa.

SSA will only issue SSN to work auth visa holders, K-3 is not. DMV is not one of the things that SSA considers as a reason to issue a number.

NOTE, Most states DMV also require proof of legal presence, some will accept valid I-94, others request EAD or Green-card for this.

I am aware of these facts -- that K3 visa holders are ineligible to receive a SSN.

The DMV in my state states that a foreign passport, US visa and I-94 are sufficient to establish identity. They also want to see a SSN or "Per DMV/DL policy 05-5609, persons stating they have never been issued a Social Security Number will be required to present documentation indicating they have been denied a Social Security Number, they are not eligible for a number, or have never been issued a Social Security Number."

I am wanting to find language, and haven't done so yet, from a federal government website, that a K3 visa holder is not eligible for a SSN. That will satisfy the requirements of my state.

According to my state, that is insufficiently precise.

She may need to go to a SS office, get rejected, and provide evidence of the rejection.

Timeline

One last note: Your timeline shows entry to the USA last November, why don't you at least have EAD by now?

Many who enter on K-3 file for EAD, and then later when closer to 2nd wedding anniversary file AOS to get AOS approved after 2nd wedding anniversary to get 10 year card, and avoid having to remove conditions later.

K-3 EAD costs less that removal of conditions.

Note: If you have not filed AOS yet, do so before visa medical is more that a year old, or you will be spending more $$ to get a full medical done for AOS.

Yes, if she goes to the SS administration office, applies for the SSN, she will be turned down. She can ask for a letter stating the reasons for the denial and they should give her one saying that she is ineligible to receive a SSN as she dos not have a work authorized visa, or words to that effect. When I first applied for SSN with the K-1 they denied me and gave me such a letter. I went back armed with the proof that a K-1 is eligible for a SSN and received one, but I know that they do issue that letter if they say you are not eligible. That should be sufficient proof for the DMV. Good luck.

Thanks, Kathryn41 and YuandDan for comments. We will apply for AOS before the medical times out in September and I hope she her green card is ordered after 10 November so she'll get a 10 yr green card.

It seems a waste to have to take a morning to get a guaranteed SSN rejection -- but since she was once a K1 holder, I cannot argue that she was never eligible even if I figure out how to prove that she isn't at this moment.

Right now we're also hoping to get the stars aligned so we can return to Russia for my MIL 85th birthday later this year without that interfering with her interview. It'll be interesting to see how well we can optimize the system for us.

I thought the interesting parts of the maze were finished when we got her K3. Wrong B)
