Hi guys.

I am currently filing Adjustment of Status (I am the stepson of a US-Citizen).

My mom is married to my step-dad and we all live in the USA.

We are in the process of filing the I-485. We chose not to go with a lawyer because we didn't think it would be necessary.

I just wanted to double check about all the files needed before we send of the paperwork tomorrow.

I-485, I-130, I-864, I-765, G-325A, I-693 (Sealed from Civil Surgeon)

Is there anything else that needs to filled out? (This all is send to the same location in chicago in the same envelope, correct?)

Here are a couple more questions/concerns that I have and would greatly appreciate some feedback on!

1. I have overstayed my so called (Visitor Visa) by almost 5 years, I came in the USA in November, 2003. Will that cause any problems?

2. I want to attend college in the Fall, I have already talked to the admission people and said that they only needed the A# and we should be good for now,

how long does it usually take till I can get a valid A#? I don't think they need the Green Card to approve me for in-state tuition.

3. SS#, How long does it take? Does it usually go pretty quick? I would like to get one ASAP so that I can acquire my license and colorado state ID seeing that my German passport is expiring in about 3 weeks.

Any answers would be greatly appreciated,

The visa overstay might be a problem...have you and your Mom been here all along on only visitor visas?? What is your current status?

Hey there. I have a question for you:

Did your step-father successfully adopt you as his son? I'm not a lawyer, but I think in order for you to successfully adjust your status, would be for your father to have adopted you legally. Depending on the State you live in, adoption rules usually allow adoption before the 17th year of the child.

Like I said, just confirm that with a lawyer.

Answers to your questions:

1. Overstaying your visa generally is a problem for people wanting to adjust their status; unless one is an immediate relative of a U.S. citizen. That's why, I wanted to know if you are indeed legally an adopted son of your father. This is key. If you are the legal step-son of your father, then, you may adjust your status to that of permanent resident.

2. Your A# is issued when you get your first Notice of Action ("NOA"). Your NOA will come in the mail, stating that you were processed into the system when they receive and review your application for adjustment.

3. As for SS#, I'm not so sure how long it takes for first time applicants. I did mine a decade ago. However, I just happen to go and fix my SSN yesterday to remove the work restriction from my old card, and they said my new card would be ready in 1-week. Maybe the same timeline exists for new applicants.

Well I don't know all the legal stuff behind it but here is the whole dealeo. My mom is married to my step-dad, my mom carries his last name, I am the only one in the family who has a different last name because I lived with my dad in germany for 14 years. I think it should all be legal seeing that she is married to him. She got all her legal stuff taken care of a long time ago and is now filing for I-751 I believe the one to remove conditions.

You don't need to worry about the lack of adoption. Since your mother is adjusting her status due to her marriage, that allows you to apply through a derivative status, as long as you can prove she is your mother and that she is married to the USC who is petitioning for a visa number to be made available to her.

I swear everyone should quit their career and become immigration advisors :lol:

Pretty much everything in here is on point. overstaying the B2 might be a little of an issue but it's not something that should cause a serious hiccup.
