K-1 Visa I-134 Question

Hoping someone may be able to help me here....

Regarding the I-134 form.

When submitting your documents you have to submit your last years tax return(Manila Embassy).

Last year I had a business which off-set my income. On my tax return my income is shown as below the level needed for support because of the fact that I had business expenses.

BUT I closed that business as of July of last year. I have a "normal" job. I make over $40k a year. I have been at my "normal" job for over 3 years.

Does anyone know what type of documents I may have to submit with my support documents? My W-2's show my income way above the needed level of support. I am wondering how this will effect my petition??

It is best to call IRS and order simple transcripts, they are acceptable in place of returns. The gross income figure on the transcripts are what they look at.

Get a letter from your current employer indicating salary, that job is full time, on company letter head.

Provide copies of recent pay stubs.

One thing about I-134, the directions included with I-134 are very old, USCIS has no reason to update them since USCIS has no application for that form.

The consulates tend to treat the I-134 like a mini-I-864 as so prefer the same financial evidence as the I-864.

In our case this what the I-134 included.

  • I-134 signed and notarized.

  • SIMPLE Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS http://www.irs.gov/faqs/faq1-6.html

  • Photo copy of IRS form 1040, and W2s for past 3 years (Not necessary if you provide the transcripts)

  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.

  • Photo copies of past month or so of pay stubs up to a few weeks before the interview.
My income was well above the povertyline so I did not include any asset data (LIKE BANK STATEMENTS or property values).

If your income exceeds 125% or (100% for military) of the povertyline when counting yourself, prospective immigrant and any dependents, then don't bother with assets (401K, Bank balance, Stocks etc..), it is just extra un-needed data to provide, the consular officer is most concerned with INCOME.

Thanks for the reply. I was also going to write a letter myself pretaining to the fact that I closed my business and have it notorized. I also was going to get my Accountant to notorize a letter to the same affect. Just to be on the safe side. I am about to browse the forums on Co-sponsor information ...just in case.

Also just so some information for anyone reading this. I moved before my petition was approved. I did the online change of address on April 18th. I got an online confirmation printout. BUT on June 5th the NVC sent their letter to my old address. This may still be ok because the address change letter states that it takes 45 days or something. BUT that confirmation number they give to you is useless. They USCIS has no way of looking to see what your address is. This is what I was told three times now. I asked what good is the confirmation number for the online change of address. All three reps has no response to that question. So as of right now I am still unsure if my address change actually got processed or not. From what I am being told, there is no way of verifing this at all.

You the citizen did not need to do the online change of address, that system is only for Resident Aliens living in the USA, not US Citizens.

If you move before NOA2 you need to call USCIS and report this so that they can mail the notification to your new address.

Later after marriage and filing for AOS, you will need to do AR-11 and I-865 any time you move, this requirement only ends after the resident alien naturalizes and becomes a citizen.
