Timeline

This is the form I am most nervous about,

My wife has completed the form, and her income for 2007 is definitely over the 125% poverty line.

She has last years W2 and her Tax Return.

She has filed every year, but due to moving does not know where her old W2's are, although we do have the tax returns for three years.

She also has a letter from her job detailing her position, salary, etc..

Is this sufficient? I have had conflicting advice on this form, some people say three years of tax returns with W2's is mandatory while some say just the last years is fine.

I would suggest that, if you don't have W2s, then call the irs and have them mail your wife's transcript.

She can have a transcript mailed or faxed, showing the last 3 years, and its free.

They are usually very fast at responding.

If you send transcript of taxes, then you don't need to send tax returns and W2s.

Timeline

Get previous three years of your spouse's IRS tax transcripts to send in. You can request them from IRS for free. It helps a lot. Best to send these if you can. When reading the form it states you may include the previous three years tax returns if you feel like it, I would go ahead and do it, read between the lines, they expect it. Although it is confusing and you could only send in the most recent previous years worth and maybe get by with that, then again there are a lot of people on here that have gotten a RFE over that also.

W2s and tax returns are good.

Letter of reference from employer is good.

I would also send along the previous years bank statements, copies of them, like one for every 3 months. Just black out the account numbers.

By all means, I would go the tax transcript route but for the record, if you don't have the W2's you don't have a tax return. A copy of a tax return is a copy of what you filed. You filed the W2's and/or 1099's. They are using the tax return to verify income. Anybody can write any number on a 1040 form. It doesn't make it a tax return.

Transcripts are a record of what IRS has on file.

Facts are cheap...knowing how to use them is precious...

The I-864 form states that you need to send the most recent year tax return (with W2s &/or 1099s) or, Tax Transcript (W2's not needed) since it is official from IRS.

It suggests that you may send the past 3 years if you feel it will help your case.

Since you have the most recent years returns and W2s, you could send that in.

But by getting a transcript of taxes, you may avoid getting RFE in the future. And you can ask IRS for transcript to cover the 3 years.

For the record, I sent transcript of just the most recent year, and that was enough to move my case through to interview stage. But every case is different.

Yes I have completed the form, but there are guides and threads (even on this site) albeit no in the official instructions that say that it must be notarized.

I am aware that this may be for older versions of the form, but I am just making sure so that I can get everything done properly in one go.
