AOS filers - July 2008

Hi VJ´s I just got my RFE today for my AOS.

I was in the US on a J-1 visa back in 2000-2002, then I returned to my country and satisfied the 2 year home residency requirement. Immigration is asking me for:

1. Submit evidence showing that I have fulfilled the requirements and conditions, that I returned to my country for a period of two years after I ended my J-1 program.

Do you know what kind of evidence I can show them?, I would appreciate if anyone can help me with advices.

I was in the US from 2000-2001 as a J1. And I was not asked to submit anything during k1 process. It is strange because you will not get K1 visa unless you complete the 2 years regulation thing.

After my J1, I came to the US as a F1 visa. But, after I finished my F1 visa, I returned to Japan. ummm it is just so strange.

I think you should be fine as long as you turned it your passport stamps. Did you include your passport stamps?

A little hello and note for the stats...

i added * all over the place for people who got their Approval by email to show we were waiting for the date of reception. (wich should be a lots of cool news in the next couple of days )

I also spent a couple of hours researching for everyone i didn't get so much news from (and figured out a couple of new dates)

So for right now, I am sending, and in order, some magical fastening waves toward everyone who did not got transfered (they will need it the most since it might be longer anyway), got any news of AP/EAD.

I want to see some more dates !

Also... my bet at the start was to receive my EAD the 26 of september.... should get it right (or a little before ?)

I got a RFE because they said I don't make enough money I have no sponsor, But I did get a raise. That would put me over the 125% poverty. with my pay before the raise I was just under the 125% by 200 dollars... If I had a letter from my employer and recent stubs would that be enough? feedback please i'm going crazy and stressed, we came so far and now this?:!

Hi sorry you had small bump in your journey. Its a good thing that you had raise.But aside from your raise and letter from employer and recent pay stubs..did you consider having a co-sponsor? It would really boost the affidavit of support to a sure approval..Just me..GOod luck to

I thought about it but, no one around me would be able to help, I make more money than my parents, my mom is part time and my dad gets aid for government from disability. No one else really so i'm on my own., but I thought I made enough I usually work 38 hours but employer wrote 35-38 I think they just took the lesser amount and went from there and I came up short :S I put down my hours thinking all was well and I am now going to school full time , and working 30 hours . I have have to drop classes now and go back to full time 35-38 hrs I wish it worked out like I thought it would.

thanks I hope i'm right and it will be approved after this... I have checks from 2 weeks ago showing i worked 38 hrs with 10$ an hr pay and If the letter says 35-38 and they go by 35hrs a week with 10$ an hr it would be $18,200 a yr. For a family of two, the poverty guidelines say 125% is $17,500. ::fingers crossed::

I think it's safer to find a co-sponsor, especially if your tax returns are below the poverty lines.

I thought they just cared about you making enough money now to support not before? I have no idea who could be a sponsor for me :S now i'm stressed about this so much...

also, If I sent in the updated pay stubs and letter and they say I still don't make enough, will we get denied or have another chance to show I can support him?

sorry to hear that. I got one on Monday because my husband did not make enough money last year (although we had a joint sponsor). He was asked to submit pay stubs for the last six month and a job letter. I believe that they just want to see whether there is a possibility that you could make more money this year. So Just follow the directions on the rfe if you were asked to submit pay stubs. Next thing talk to the lord and trust him. In May my husband was offered full time when he asked for an employment letter to sponsor me. If i were you i would wait a few weeks before i sent the required evidence since you make more money now (that depends on the no of days you were given to submit the evidence). That way you can proove to them that your salary has increased. I know that you want to get this over with but a little patience does not hurt. I have my required documents but I an going to wait till next week to send them cause if my husband gets two more pay subs it will show that he made enough money this year to sponsor me and my kids already. We have 87 days to submit the requested info
