I am extremely worried about one thing and I want to ask you VJ friends to give me your opinion. Before sending the AOS+EAD package I was preparing to go to my medical, but I needed my vaccination record which was in the sealed envelope I had to bring with me at POE. All those papers were sent to the local office here in Cleveland (including the medical papers I had taken for K-3 visa). I made an appointment at the local office and when I went there to request a copy of my vaccinations (so that I wouldn't get immunizations all over again) the immigrations officer told me that K-3 are not required to have another medical, especially since mine was taken just one month before...

My worry is that I might get the Boggie-man RFE... I happened to read the instructions on the I-693 (medical examination form) and they state that:

2. What if I am a K nonimmigrant visa holder and

already had a medical exam overseas?

A. K-1 fiancé(e) or a K-2 child of a K-1 fiancé(e), or as a

B. K-3 spouse of a U.S. citizen or a K-4 child of a K-3

spouse of a U.S. citizen, and

C. You received a medical examination prior to

admission, then-

a. You are not required to have another medical

examination as long as your Form I-485,

Application to Register Permanent Residence or

Adjust Status, is filed within one year of your

overseas medical examination.

b. You will, however, be required to complete Part

1, Information about you, and submit the

vaccination section of Part 2 with your

adjustment of status application. A designated

civil surgeon must complete the vaccination

section and Part 5, the Civil Surgeon's

Certification.

Yeah right?!!??!? Which doctor will sign this form and complete your vaccinations without making you go through another medical...?

I am so depressed... :cry: and don't know what to do... I have biometrics on Aug 19th and I'm going back to the local office. Do you think there's anything I can do? It is so not fair.. the customer service b***s**t tells us nothing.. they just read the instructions from the freakin' computer... :unsure: And when you finally talk to someone ALIVE and not just customer service, BUT AN IMMIGRATIONS OFFICER you kinda trust them, because they are supposed to KNOW!!!!!!!!!!!!!!!!!! URRGGGHHHHH.... I am so mad.....

Any advice?

- aug 6 - Bio letter

- aug 11 - RFE e-mail (I-864)

- aug 19 - Biometrics done (they scanned my little fingers maybe 20 times because fingerprints were not clear enough :P )

Sorry to hear this...as what you read k3 still required the vaccination section of I-693 and part 5. Yes most civil surgeons would want for us to redo the medical before they sign BUT there are few civil surgeon who would agree with just the vaccination part and still sign the I-693. You just have to call as many civil surgeon as possible and get the cheapest price (Luckily found one). In your case its already being process, I guess all you can do now is to wait if they will send you a request on this part. good luck..

Did you already send it in? If so, there's NOTHING you can do about it now. If an RFE comes, answer it. Did you include the vaccinations worksheet (DS-3025), that you should've gotten from the medical doctor, with your AOS? That's what some people did and have not gotten RFE'd. That's what my wife and I did. 2 weeks ago we sent the AOS with just a copy of the DS-3025. We'll see what happens, but an RFE is not the worst thing in the world, why are people so afraid of it? :wacko:

Technically (according to the instructions), those who had a medical within the last year only need to send part 1, vaccinations, and part 5. The tricky part is finding a civil surgeon who isn't a greedy mother-f'er and will just transfer the vaccination worksheet to your I-693, without charging your $250-$300.

That's funny...... All transfer so far are at CSC... doesn that mean people waiting longer will be transferred at their local office (+interview) ?

Obviously the transfer and biometric have nothing to do one with another since some people get transferred even before their biometric.

I already saw many people who did not get the 3 NOA1... I don't think it's a big problem but just a stressful one :)
