My husband recently went for his IR-1 interview in London, and was told that NVC hadn't sent his i864, so he would have to send a new one via courier, and they would reconsider it. So we've done that. But the problem is, that she gave him a piece of paper stating that we had been denied a visa because I declared $20,113 as my income for a household of 3 and this was not sufficient. I declared considerable more than that in the space where i was supposed to, and know it was sufficient. The space I wrote the above amount in, was on page 3, part D question number 3 of the Affividavit that reads like this...

3. Minimum income requirement from the Poverty Guidelines chart for the year ____ is _________ for this household size.

So I filled in for the year 2005 is 20,113. And they took that as my declared income! But right above this section in big bold letters was the line that declares the total household income! Was this my mistake or theirs? It has caused so many repercussions for my husband and I, least of all that he won't be here for the birth of our second child now...argg. What should I do? i mean I sent a new affivadit of support back to the embassy already, and spotted this mistake shortly thereafter.

Why dont you email them if you think a mistake has been made, this might save you some time, rather than waiting for snail mail to be told!!!

Did he get a 221g wanting more evidence or a flat out denial? If you have the 221g and have noticed the mistake I would contact the embassy via email and tell them you did the forms incorrectly and to please look at them again for you.

On your email make sure to put his name, and visa number and the mistake.

I do not know if this will help or not? And I am sure if I am not correct in my thinking someone else will come along with some advice.

Good luck and will keep you in my thoughts and prayers.

Mary

If you did earn $20,113 that is the right amount for family of 3 people. Or is that what you ment? Im not sure I understand all of your message.

That is why they said we had been denied a visa, because the sponsor only declared $20,113, but I didn't understand why, even if they got that wrong, we were denied a visa since that is the minimum! The NVC apparently only sent that with the file, and not the actual affivadit we sent them, so the immigration officer didn't even get to see it herself, so she said to just do another one and send it in via their courier and gave him the instructions on how to do that. It won't do any good to write london with that, so where do I write about that, or should I even write about that, since we've already sent in a new affivadit. We put pretty much the same information on this one, and I'm hoping someone will actually read it and get it right it time, only I'm scared to leave it to chance now.

Part 4 Section D 3 is the space where one fills in the poverty guideline figure for the total number in household and the year of the PG consulted. As far as I can see, you did not fill it in incorrectly.

The NVC apparently only sent what with your file? A denial?

Could you please elaborate on your case so its easier to understand...since this is the first I've heard of an income based denail at London maybe your story will be helpful to others.

It's very strange that the NVC wouldn't send the Affidavit....I can't quite understand that one?!

Also, did the embassy just ask you to send back a new I-864 instead of making a new interview apppointment?

I remember filling that in too. We did exactally as you did. I seem to remember thinking that they wanted to know which poverty guideline we were going by. There is a different spot to put your income. Ours was fine and we did not have any problems with this. It sounds like they may have made a mistake on yours. I think all you can do now is to innodate them with calls and emails untill it gets corrected.

Oh by the way...I felt so bad hearing your child is coming before your husband....hang in there.

Best wishes

I just noticed your CO is in Nigeria. . You may want to post this in the Sub Sahara Africa forum.

I have understood the case, this is not your mistake , you correctly put the right thing in right spaces, but i think the CO who looked at the form made mistake, i think you should e-mail them describing and identifying the problem n mistake they made, i hope they will reply positively...and that will save your time too...

wish you best of luck
