Hello. I have a question about divorce certificate in US.

We are preparing the documents for processing K-1 Visa right now.

Well, my fiance(American) has divorced before and we need his divorce certificate to prove the prior marrige is legaly ended right? Where can he get his divorce certificate in USA?

Is there any official certificate that he can get?

Please advice.

Did he get his Divorce Decree when he divorced? If he doesn't have it he may be able to get it from his Attorney or the Courts.....

he needs the divorce decree, Yes. If he has it...good. If he does not have it, he needs to contact the place where he got the divorce, they should have copies of it. They might change $5.00 for a copy of it. When he sends the Divorce decree with the 129-f, he only needs to send in a copy of the divorce decree, make sure he keeps the original, if they need the original they will ask for it later, and if they ask for it, they will mail it back, but if they don't ask for it and he mails the original, USCI will keep it.

I was divorced before this marriage. I had to go to the court house and they pulled up my files. I had to have change to make copies of it myself and then I paid $15 to have it certified. I think the way they handle it may vary from state to state and county to county, but I went in and got it and was done in a very short time. I got two of them so that I could keep one certified copy and send one to my current husband in case he needed a copy of it in Canada too.

Case Complete: 12/1/2008

Interview: 03/24/2009

Received approved visa (after RFE in interview): 04/21/2009

Called County District Court where I was divorced and they had me send $12 for 2 certified divorce decrees. They mailed them to me [sent them a stamped addressed envelope]and I got them 7 days after I first called.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

!! ALL PAU!

I was divorced in 1970 and don't even remember the date. I never had a decree. I was remarried two years later and that ended after 35 years with my wifes death over a year ago. I have these documents. Since it was so long ago and since I could not remarry if I wasn't divorced would DHS give me a pass on old documents ?

There should be a record at the court that handled the case. It would be better to spend the time to get it up front than to get an RFE and delay the process. If you are feelling lucky you could sent it without the decree and get it while it is processing.

You need to get the decree. There is a registry of deeds office that handles all of these documents. Find our where the divorce was granted and get a certified copy of the decree. It was $20 in MA.

You will also need the death certificate for your second wife (my sympathies).

Just for the benefit of those reading, if you are a woman who has been divorced and took your previous husband's name, you will need to send along a copy of your marriage certificate as well to show legal proof of name change. This is in the guides but there have been quite a few people who received RFE's for missing this so I thought i'd throw it in there. ;)

The USCIS will not give you a pass.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

Ugh. I had to call my ex-wife from over 35 years ago and ask her help for divorce decree papers. She was willing but I had to listen a very long talk on my foolishness in looking for a foreign bride.

If you'd taken the advice given and contacted local county clerk where the divorce was granted you could have avoided that conversation.

The quick and easy way to find out how to get a certified copy of a divorce decree is to simply google "Statename, certified copy of divorce decree". Some state's will provide them at the State level and others only at the county level but the google will get you to the information you need.

Unless your former spouse has a certified copy she's willing to part with, she can't really help you much anyway.

Facts are cheap...knowing how to use them is precious...

I'm assembling the docs for my packet... this thread made me question myself. I was going to submit a photocopy of my multi-page divorce decree. Is that acceptable? Or do I need to order a certified divorce certificate? They're apparently different things, at least here in Idaho. I'm so confused now.
