My wife wants to file for her mother. Will her brother (21) be included in the petition

My wife is going to becomea US citizen soon and will apply I 130 for her mother. She has a younger brother (under the age of 21). Can he be included in the petition.

My understanding is one I-130 per person, but the instructions are very confusing and this even including a child of the mother that required another I-130 that was well under the age of 18 that seems to be the cutoff point. And as the sponsor, cannot forget the I-864, not aware of a health insurance company that covers the medical end of it so that's cash out of the pocket and some of these medical organizations really know how to charge.

I was able to talk to quite a knowledgeable and helpful USCIS officer and gave her all the details of what I wanted to do, and she listed out all the forms that had to be filled out, but still elected to hire a good immigration attorney as any errors on my part could have resulted in loss of fees, but more important extra delays that can be months if not years.

The people you are petitioning for also need documentation, birth certificate, marriage, etc, and if in a foreign language would have to be translated into English by a certified translator and they may have to get police reports to verify they don't have a criminal record. Also should have their medical records and in particular shot records. It does get complicated.

Yes, all siblings regardless of age go under a different category. She will need to file an I-130 for her mother and an I-130 for her brother. He mother's visa will be processes a lot faster then her brother's because again, they're in two different categories.

03/30/11 - N-400 sent via Priority Mail w/ delivery confirmation

05/12/11 - Biometrics

07/20/11 - Interview - passed

07/20/11 - Oath ceremony - same day as interview
