K1 interview canceled by USCIS...why??

Our petition just got cancelled under identical circumstances. The reason I was given is the introduction of IMBRA. See my thread for details.

Im not sure if they used the term canceled. My fiance's interview was tomorrow morning and they canceled his interview stating that USCIS requested this due to the IMBRA law. They said they would review it again and if approved, the appointment would be rescheduled. I really dont know how long its going to take but if they are going to do this with all the petitions approved after march 6th then there are going to be ALOT of unhappy people. I have not yet found a way to get around this issue.

Cancelled was probably a misnomer but that was the language they used when I called. Since the indication was that the case would go back to the original service center for further adjudication I assume this means things would then proceed subsequently if everything was in order.

Hopefully they'll put a rush on the affected cases.

yea i know they said that USCIS would have to review it again. Seriously it seems like its gonna take a month before we hear anything if its gonna be going back to USCIS. hopefully these cases are prioritized before all the other cases. I just cant believe they waited this long to do this when they had the chance while my petition was with them. Hopefully something good comes out of it.

Oh my god! This is terrible and downright wrong.. of course it's the law targeting the WRONG people... I thought the law would be kinda geared towards the countries that have lots of marriage brokers and female trafficking problem (Not picking on any certain country but E. European and Southeast Asian countries) ???

Hey guys, so i am very sorry to hear about this experience you ar ehaving. i went online to try and find out as much as i could and this site is great for answers http://usaimmigrationattorney.com/nucleus/index.php?itemid=2 . did you say that you met through friends? cuz it did say something about checking some people who met through friends or family not just people who met through IMB. that could be why that is. it also said that most people who applied before march 6, 2006 will not be checked but some will. it looks like people applying in the future will have to deal with this more than people who applied before that date. its just unfortunate that it happened to you. for some reason they think that the reason you met is a little suspicious i guess. it says also that this is not only limited to USC males. please read this site is has some really good information and i hope that this helped a little. i hope everything gets better for you!!!!

we were childhood friends. we didnt meet thru friends. i dont really know whats going on but i'll read that site and also update once i find out more. thank you for all ur help.

this law doesnt seem to apply to me at all. this is the first time i have ever filed a petition. we dont have a criminal background. we didnt go thru any agency or anyone else for that matter. we have known eachother since we were little. i read everything on that website and none of it applies to us. i just dont know why they selected us. maybe there wasnt sufficient enough evidence to show that we didnt go thru an agency or meet thru friends?

USCIS Re-called application for K-1 for March!!!

TimeLine

December 8 2004: Filled I 130

Jan 27 2005: approval and priority date which was Dec. 30 2004. NOA1

March 2nd 2005: Received visa processing fees and Affidavit of support fee Bill IV

March 5th 2005: Send fee bill via Registered mail.

March 7th 2005: Got message that they have received the Fee bills and in process to generate the I864 and DS 230.

Long wait of period then:

Exactly 25 working days later

April 26th 2005: Got package at lawyer office.

April 29th 2005: Got DS 230 Signed from my spouse from India.

May 1st 2005: Mailed express(Fedex) overnight the package.

May 5th 2005: Case completed.

May 11th 2005: Case sent to Indian US embassy(Mumbai)

Waiting for interview date now.

YEAH...Finally.. the date is here.

July 13th Interview(Exact two months after case completed at NVC and sent to Mumbai Embassy)))))

June 20(approx) Police Clearance.

1st July Medical!!

13th JULY Interview and APPROVED!!!

HAPPY REUNION on 18th of JULY after 7 months and 5 days of Sending out the I 130 to interview approved!!

17 July Got Letter 797 for Green Card issuence!

28 July SSN Card.

8 August Green Card recieved.

You are missing your Criminal Affidavit. Did you file one with you original Petition??

what criminal affidavit. I followed all their requirements. All i needed to submit at the time was my I-129F with the evidence. It never said anything about a criminal affidavit. Plus my petition was filed before this law so it shouldnt even affect me! but still they cancelled our interview =(
