i had my second interview and i was denied because we are married

the interviewer told me that we have to do k3 visa not k1

so i need your help for this kind of visa ( k3 ) !!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

because i don't know what documents i need

Start with the K3 guide. Are you really surprised the Consulate wouldn't issue a fiancee visa to a spouse?

Seems to me that you weren't denied as in 'never going to happen'. :unsure:

You have been denied purely because you've applied for a fiance/ee visa although you're already married.

It seems to me all you need to do is go through the procedure for a K3 visa right?

or you can apply for a CR-1 (married less than 2 years) or IR-1 visa (married for more than 2 years). I suggest you do some research on your options. :)

Why would you apply for a FIANCEE VISA when you are already married??

Removal of Conditions Timeline:

03/19/2008 - package sent to TSC, let's hope for the best

03/20/2008 - check cashed

03/26/2008 - case sent to Vermont Service Center

04/17/2008 - Biometrics scheduled

05/19/2008 - received I551 extension stamp via INFOPASS

02/12/2009 - APPROVED

02/21/2009 - GC received...no mistakes...valid until 2019

How did this happen? U filed k1, (then Married)? and if so why did u do this knowing it would be wrong visa. Im sure by reading on here u would know not to be married........anyway now u need prob do the cr1 and plan on about a year more wait.....i just cant believe u would start k1 then marry knowing it would stop the case as it was.

when we began the procedure we are not married

we got married after my interview because i can not go with my husband with out marry him because my parents don't accept that we are muslems

after my interview , the interviewer give to me the 221 g AP and i am waiting for 9 mounth.......

in my second interview the interviewer told me if we got married i say yes

she told me thank you for your response and you are ineligible for this kind of visa and your husband must to apply foe you the k3 is the faster procedure than the cr1

i told the interviewer the truth!!!!!!!!!!!

now we have to began the new procedure k3

how long it will take this k3???????????????

what i need like documents for apply the k3.??????????????

About a year - same as the K1.

Lady, people aren't chocolates. Do you know what they are mostly? Bastards. ####### coated bastards with ####### filling. But I don't find them half as annoying as I find naive bobble-headed optimists who walk around vomiting sunshine.

don't you know that they will deny you if you get married before you move to usa????

Better now than then, if you follow.

The K3 process really isn't too much different than the K1, just a couple extra forms is all. Read the Guides at the top of the page and if you've already done the K1, the K3 shouldn't be a problem.

divorced - April 2010 moved back to Ontario May 2010 and surrendered green card

Im sorry this happend to you, but it did. File for a K3 or a CR-1 California processing center is pretty quick in the recent months with the married visas.

Keep all your evidence emails, letters to your husband and his to yours, etc, that you had on your K1 filings, and keep adding evidence to your new file that you will need for your interview again at the embassy for your K3 visa. I understand you being honest when she asked you if your married or not. You can do this and get thru this. Your a strong girl. And many people will be glad to help you, myself included with the forms you will need.

Its easy, only one extra form then what you had, and you need wedding photos.

Was the lady who interviewed you named Maureen? a blond headed lady???

yes its over and done nothing can change now BUT you knew this before because you post may 15 and acknowledge this was done> I think you see now that to wait before and not live together if that was case would have save you alot now few weeks to wait would have been easier and cheaper than to start over and wait a year more but its done now and yes u always have to tell truth. I would recommend the cr1 to file now, both taking about same time

I'm afraid nothing out of the ordinary "happened to" this couple. They are the ones who decided to get married while waiting for a fiance(e) visa. Time to stop whining and get on with filing for a spouse visa.

Im really sorry for you. I can understand how you feel right now. But now bcz it is done, you gotta be strong and start your new Visa journey asap. Don't delay filling the required petitions. As advised by experiences VJ members read the guides and start filling the forms.

12th Sept 2007 - sent I 130 to CSC

5th Jan 2008 - Received NOA 1

16th May 2008 - Approved (NOA2 in 247 days )

18th May 2008 - Touch (Guess its been sent to USCIS mail room)

20th May 2008 - Received Hard Copy NOA2

I 129 F

7th Jan 2008 - Sent I 129 F to CSC

10th Jan 2008 - Received by CSC

18th Jan 2008 - Received NOA 1

16th May 2008 - Approved (NOA2 in 130 days )
