UK citizen in USA applying for AOS

Hi all

I'm new here, I've already had a few questions asked and am finding the site great.

I'm from N. Ireland, my husband is from Charlotte, NC, USA - we married just over two and a half years ago and have lived in the UK ever since - while visiting here in the US, we have decided to try and stay (there was a change in circumstances) so we are applying for an AOS for me - eeek so expensive and time-consuming, hopefully it will all be worth it :)

10/13/05: Married in the UK

living in the UK

02/02/08: Husband becomes permanent resident of UK

04/16/08: Visit in-laws in USA, husband gets offered permanent job

AOS:

06/19/08: AOS Packet Mailed

06/28/08: NOA Date

07/17/08: Biometrics Complete

08/30/08: Request for Initial Evidence Arrives (I-485) (booo)

Keep in mind you will be interviewed for adjustment of status and you may have to convince the interviewing officer that whe you entered the USA that immigrations was NOT your intent.

If you are already married, and your spouse came to the US on a tourist visa with the intent of immigration and marriage, then he/she should return to his/her home abroad, and the I-130 (or along with an I-129f for a K-3 Visa) should be filed with the relative outside of the U.S. to avoid denial, deportation, or even being banned from re-entry to the US.

The above conditions are serious and can result in the separation of families for many years if not taken seriously.

yeah, I'm aware of this - it scares me a little, but we own our own home, a car and are active members in our church in the UK - it's all still sitting there waiting for our return

We also went through a lot of trouble to get our dog a European Pet Passport so she could travel with us (to here) then back home again :) I amy seek professional advice prior to the interview if enough people tell me to haha!

All of the above would actually work in your favour and you need to start gathering evidence of it all. Having a home, car etc. in the UK awaiting your return proves that your stay in the US was not your intention when you came here and that you always intended on returning. Like I said, start gathering evidence of this kind of thing just in case it comes up, which it may not even do. Good luck with everything. :thumbs:

You probably should sit down with a QUALIFIED COMPETENT immigration attorney before you file.

Good Luck with the AOS!.. did you also apply for an EAD so you can get a SSN, DL and of course a job if needed! One bit of advice from experience, put your name on the outside or inside of your mailbox. The stupid postman (mailman) returned my EAD... by the time we found out and had it sent out again I had my Green Card a few weeks later.. I hate to think if we didn't catch that and they returned my Green Card!!
