My stepson in China was under 18 when his mother and I married. She has since gotten her permanent residence card.

We put in an 1-130 for her son and received our NOA on December 5, 2003. It is now 5 years later and we still don't know what is going on.

In July 2004 we received a notice that the application had been processed and was being transferred to the Chicago office. After going well beyond the processing times I went to our local Vegas office and they said the case had been transferred back to the California Service Center and that they could give me no info. I have written to the Cali center with no response and there is no other way to contact them.

I call the national 1-800 number and all they can tell me is that the case has been transferred, but they cannot tell me when or where and tell me I need to speak to the Vegas office. I go to the Vegas office and they say I have to call the 1-800 number. I cannot get any answers.

I have tried writing my Senator, and made several inquiries which only tell me that to check again in 6 months for the past 2 years.

Can anyone give me any information, we are really distraught over this.

Sounds like time to get your congressman involved. That is about all you can do. They do intercede in immigrations matters like this.

Why didn't you bring your stepson at the same time as your wife? This is something I hired an immigration attorney for so all the procedures were followed, after the kid turns 18, it can be murder to bring them here. But guess you are finding that out, now.

When I first read all the forms, even with a college education, was confused, read that I-130 ten times read it one way it covers both the mother and the children, read it another way, need a separate I-130 for each child, this is the correct way, by the way. Our major problem was not with our USCIS, but with the home country of my wife's child getting them to release her. That added about a year to the date we wanted to get married. But hey, this is a human life we are talking about.

The CSPA is very confusing however it is pinned here but here is the links. There are 2 of them since they both have information from a great member who went through this. There is even a calculator that will help to know if the child qualifies for the CSPA.

A lot of reading and YES it is a bit of a bear to understand. I wish I could help you more. However like NickD said why did you not bring the child as a Step child of a USC?

Why is it that the only one who can stop the crying is the one who started it in the first place?

Who is "we"? Did you petition your step-son or his mother? How old was he when the petition was filed?

Thx for the responses. The wife was already here on her way to getting the Permanent Resident card. The I-130 was filed by me to bring my stepson over. His mother and I were already married and he was under 18 when the app was filed. I also have a college education, and just feel overwhelmed, lost, and confused when it comes to understanding all this stuff. It doesn't help that each INS agent seems to have different and contradictory information when I deal with them.
