My Fiance' called this morning and said she was denied her K-1 Visa :angry:

We need to know what to do from here?

Her Interview was a few days ago, she said they told her everything was fine, but she needed two more years of my W2s?!?!? I had sent the 2007 one in the I129F / 134 package, I didn't see any request for 2 more prior years in the documentation and guides or I would have sent them.

I emailed them to her and she took them back in yesterday, they told her to go to some counter where she delivered the W2s. The man at the counter gave her back her and her sons passports they had taken at the medical, and told her she was denied and would have to re-file if she wanted to try again.

And that was it! She tried to find out why, he wouldn't say, he just blew her off and told her she would have to try again.

#######!!! What a bunch of bull ####. How the hell can they deny someone and not tell them why?

She was so prepared. She had all the documentation and relationship evidence organized and tabbed and everything. Not braggin here, but I make $100k a year, had real estate, stocks, etc. listed, 2 years of Long Form Tax returns documenting all of that. All of our trips together, my phone calls, Instant messages, emails, you name it, it was there. Everyone I talked to said, no problem, its a rubber stamp.

This feels like such a bull #### attempt for them to extract more money in fees. All the time and effort and money spent to do that and they just say , sorry your denied better luck next time?? I'm really glad I wasn't there or I would probably be sitting in Jail right now for ringing that #### neck.

So now I have nothing but questions....

Anyone know who's the corrupt SOB is that I have to bribe over there to get this damn visa?

Do I need an immigration lawyer?

I was read here in a few places that it was better if I wasn't there for the interview, would that have made the difference? Do I need to fly over there and go through the interview again?

Where does it say on that documentation that we need three years of W2s ??? How did I miss that? Was that just an excuse for them to deny it? I don't see how we could have been anymore prepared.

Do I have to put that whole package back together again and send it to her? They didn't give any of it back to her.

Do we have to do the whole medical thing again ?

Has anyone else been through this denial at the manila embassy that can provide some guidance here.

I'm so pissed off right now I can hardly work today.

im sorry to hear and we know exactly the feelings. anyway, the only thing that came to my mind after reading your post was if she was asked about taking illegal drugs? I am not saying she is but maybe she misunderstood the question and answered it wrong. having incomplete requirements, I dont think she will be denied coz usually when you have incomplete requirements, they usually put you in AR only though it will take a month or so. if i were u, i will ask her what questions were asked so that you would have atleast idea why denied.

im sure some of the people in the forum know somebody to help you reapplying K1.

02/05/08 (9th day) - check cashed!

02/11/08 (15th day) - received NOA (I-797) GC extended for 1 year!

03/06/08 (39th day) - biometrics appointment @ 10am - DONE!

05/23/08 (78th day) - received 10-yr Green Card in the mail

May 30, 08 - passed written driving test (1st attempt) & got temporary permit yipeee !

read around in the MENA group we have to fight denials and returns all the time. You want to get it held there not return, any idea why it didnt go thru? Its not my embassy BUT what we have to do is get your state rep on it now like i say u want it held there. But we really need to know what they were thinking not a true relationship, havent known to long, etc etc You get your rep on it like i said, have friends and family do letters about your known relationship (both families) think about the questions asked and the answers given. Was money mentioned in the questons?

Yes, they are correct. If I were you, go to Philippines and check with the embassy what's the real reason of denying. it's very impossilble that you will be denied by just

lacking of evidences or W2. During my interview, one of my friends lacked of financial support then the consul said to provide more co-sponsors and forward it to the embassy

then after a month she was issued a visa. Regarding about genuine ralationship, my husband and I has only 2months of getting to know each other before he petitioned me. We don't

have much proof of relationship. Hope this can help you.

I think this is where a immigration lawyer could come in handy! It would also be helpful if you filled in your timeline :blush: In this situation i would call a immigration lawyer with expierience and have them contact the embassy and ind out what the deal is

Thanks for the response. She didn't mention anything about being asked about illegal drugs, or anything like that. She said the interview was not very long and the lady was nice and asked a few questions of her and her son about me and our relationship and that was it. She was very happy after the interview, the lady was nice to her and it was basically left at the point of, turn in the W2s and you will get your visa, in fact she was so sure, that she thought she was going to the window to pay the fee for the visa, not to have this man tell her she was denied.

There is definetly more to the story... You need to get involved ASAP with the consulate before her file is returned stateside....

That was my thoughts too, the only thing I have is a number to call them for appointments. Is there anyone specific I should call or ask for? Is there another number other then that one to use for trying to find out whats going on?

As I wrote in my initial post, we have NO IDEA why it didn't go through. They didn't give her paperwork, they didn't say anything but try again, better luck next time.

We've been together since Feb 07, I've had two trips to there to see her, the initial visit of a couple weeks, and then spent a month there, and thouroughly documented all of those visits, plus the apartment, the phone and internet connection and everything else I have set up to show support for her. That seems to be considerably more then what other people have done who were approved. Your asking about money mentioned, why? what do you mean by that?

How do I go about getting my "state rep" involved in this asap? what is their role in all of this? who would that be for California?

Sorry to hear about what happened. That's strange because they don't normally deny the visa, not unless the applicant admitted using drugs or if they (embassy) found out that the applicant is married to somebody else and was hiding it or if the applicant has communicable diseases. etc. If your fiancee was just lacking of some requirements/documents, she'll be put to AR (administrative review) and won't have her visa until such time that she's able to turn in the missing papers.

Anyway, here's the number you can call: 011-632-301-2000 ext. 5184, look for Lorraine or Grace. Make sure you got your fiancee's Manila Case Number so they can check it out in their system. You need to get involved and make calls before they return the application back here in US.

You should know who your state rep is as it is based on where you live... Some one in Fresno would be different than San Diego. You also have two state senators whose constituents are all residents of your state.

well, easier said then done, I can't just tell my employer, sorry I gotta go to the embassy in manila and have a chat with some berocrats, Ill brb...

Which is why both of us are in shock at this time. Again, there was NO REASON GIVEN... Just try again!

Again, we had volumes of relationship evidence. I really don't know what the reason could have been. My fiance is college educated and articulate. She has worked in call centers so she knows how to communicate with people, there was no indication in the initial interview that there was any problem at all other then she had to come back and show the "missing" W2s ( I still haven't had anyone show me where the forms requred for this K-1 process call for 3 years W2s, I can't find that reference anywhere. How can they just pull that out of their ### at the interview.

I don't see how a time line has any bearing here. we met, got engaged, the 129 was approved, and months later we got the interview and denial

If an attorney is necessary, does anyone have a good Immigration Lawyer in the SF Bay Area of California?

and you won't... the financial information review is 100% subjective. There are guidelines but no rules.

You do not need a SF Bay area attorney... You need a competant immigration attorney experienced most importantly with the US Consulate in Manila.
