Timeline

Hello VJ users

My husband entered the States several days ago under K3 visa, it was the happiest day ever :)

We're getting ready to adjust his status but I m really confused as to what the next step would be. If someone with experience could guide me I would appreciate it

Depending on length of marriage, some on K-3 will file for EAD and then wait a bit before filing for AOS, so that hopefully AOS is approved after 2nd wedding anniversary, this way removal of conditions from a 2 year green-card is avoided, approval after 2nd wedding anniversary results in a permanent 10 year green-card.

Begin by clicking on the word "Guides" at the top of any page here. Somebody has already kindly layed it all out for you.

We waited long enough to file so the adjustment was approved after out second wedding anniversary but the fee structure was different then.

I am still bit confused. I thought EAD AND AOS were the same thing ??? Does this mean if I go ahead and file for EAD and pay $1,100 fee will my spouse eventually get the green card or will more paperwork need to be filled . Oh man this is way confusing than I though :(

When can he apply for a social security card, get his US drivers license...

Oh yeah...and we've only been married for 9 months now,does it matter what we apply for ?

Step by step guides will walk you through this if you'll just study and folllow them. We're here for specific questions once you've used the reference material already provided for you.

EAD is an employment authorization document. AOS means adjustment of status to permanent resident. The fee is $1010, not $1000. Take it one step at time.

There is a specific forum for AOS. Read a lot there too.

Your spouse can apply for a social security card after he gets an EAD (employment authorization). Most states require a social security number to get a driver's license or state ID.

What Yu and Dan was referring to is if your AOS is approved before your second wedding anniversary you will have to apply for Removal of Conditions I-751 ($545 US). If the AOS is approved after the second wedding anniversary you can avoid Removal of Conditions.

You can apply for an EAD seperate from the AOS with form I-765 ($340 US).

3/23/14 - N400 package sent to Phoenix

3/27/14 - N400 package delivered

4/3/14 - NOA1 receipt date

4/4/14 - check cashed

04/29/14 - biometrics date

07/01/14 - interview date

xx/xx/xx - Oath Ceremony

Ok this is making more sense to me know

So it s okay to wait to file for AOS and just go ahead and file for EAD now so my spouse can start working ASAP

One more question...How long does it usually take for AOS to be approved ?

Our 1 year wedding anniversary is on August 8. Would You suggest we wait until maybe end of the year ???

Any answers would be appreciated :)
