USCIS AND FBI RELEASE JOINT PLAN TO ELIMINATE BACKLOG

OF FBI NAME CHECKS

Partnership Establishes Series of Milestones To Complete Checks

WASHINGTON – U.S. Citizenship and Immigration Services (USCIS) and the Federal Bureau of Investigation (FBI) today announced a joint plan to eliminate the backlog of name checks pending with the FBI.

USCIS and the FBI established a series of milestones prioritizing work based on the age of the pending name check. The FBI has already eliminated all name check cases pending more than four years.

“This plan of action is the product of a strong partnership between USCIS and the FBI to eliminate the backlogs and to strengthen national security,” said USCIS Director Emilio Gonzalez.

By increasing staff, expanding resources, and applying new business processes, the goal is to complete 98 percent of all name checks within 30 days. USCIS and the FBI intend to resolve the remaining two percent, which represent the most difficult name checks and require additional time to complete, within 90 days or less. The goal is to achieve and sustain these processing times by June 2009.

The joint plan will focus on resolving the oldest pending FBI name checks first. USCIS has also requested that the FBI prioritize resolution of approximately 29,800 pending name checks from naturalization applicants submitted to the FBI before May 2006 where the naturalization applicant was already interviewed.

The target milestones for processing name checks are:

Completion Goal Category

May 2008

Process all name checks pending more than three years

July 2008

Process all name checks pending more than two years

Nov. 2008

Process all name checks pending more than one year

Feb. 2009

Process all name checks pending more than 180 days

June 2009

Process 98 percent of all name checks within 30 days and process the remaining two percent within 90 days.

yeah, I agree. This does not seem really feasable. It will be backlash though once you go to the visa interview at the consulate, they will do the name search then, so once you think you can get your spouse home... NOPE... FBI NAME CHECK makes you have to wait for 2 more years.... sorry I am a little cynical today.

08-21-2008- NOA2 Hardcopy received

09-06-2008- E-mailed DS-3032 to NVC

09-11-2008- Received Hardcopy of DS-3032 and AOS Fee Bill

the thing is I even mailed a letter to the President (White House) and they transferred it to Dept of Justice who then forwarded to FBI (Names Records Division - Chief) and he wrote me back a letter (to my house) stating I had NO SECURITY CHECKS on my two cases and to please recheck with local office again.. so the USCIS is lying to me :angry: :angry: I don't know why.. if they wanted something, they can just ask for a RFE.. I never received a request so far.. I hope the lawyer I hired can do something for me..

Why do you think the fees were raised?

Go back and read Congressional Testimony plus other publications prior to the fee increase. A sizeable portion of the 'new monies' are going directly in payment to the FBI to reduce the backlog.

The backlog reduction is real.

maybe so, I actually checked and it seems my security check would supposedly clear in November 2008.. man, 1 1/2 years just to get approved.. :crying: :crying: and by that time they would probably have another excuse.. they told me there are other places to do security checks, not just the FBI.. :angry:

We don't know a whole lot about the type of check you are undergoing. As you know it's more rare for a petition to get held up with the supposed issue of 'security checks' as this part of the process.

The checks referred to in the OP's memo have mostly to do with AOS and NATZ petitions. If the FBI is involved in checks for a a visa petition, we can only assume they would also be under this mandate - but I don't think we know enough about that to say with certainty who or what agency is performing any checks on your case.

Guys!!!

The way I understand that news is that AOS will be adjudicated regardless of pending Name Check if pending more than 180 days... but for the the rest will apply their target plan... for all name checks that are pending is expected to be completed June 2009 saying that by that time securty will be done only within 30 days... or 90 days :help:

lets just hope that this is not another lie from them.... like the K3 that is supposed to reunite husbands and/or wife of US citizen faster right? (WRONG!!!!!)

AND like the fee increase to make their service efficient and fast ( WRONG!!!) :lol::no:
