OUR Petition story just so it helps clear up any Questions:

We did Direct counselor Filing in Delhi. I am the sponsor

She had her Interview April 4th. Seems the consular that interviewed had a problem with the fact that I had been married before even though she had the original divorce certificate in hand issued by US court where the divorce occurred in 2001. Well she had her finger prints taken and paid the Visa Fee but was told to submit a list of things to her local VFS

1) Additional proof of relationship, including but not limited to:itemzed phone bills, Emails, Postmarked letters or card.

2) list of 20 marriage ceremony guests, their relationship to you, their addresses and phone numbers. please do not include immediate relatives.

3) list of vendors and contact information from your marriage ceremony. Also submit catering bills and bill from hall, ect

4) Photographs of you and the petitioner before , during and after marriage

5) Notarized passport copies showing petitioner's travel to India.

6) Family trees from the beneficiary and petitioner back to there paternal and maternal grandparents. plus include all aunts, uncles. and cousins and their contact details.

She submitted everything they asked for number 1 alone lots of pics during wedding and honeymoon, joint bank accounts, Hundreds of hour long phone calls, Text messages, three letters I sent her, That fact that she has been added to my health insurance plan as my spouse, Copy of my passport pages of when I was in India, I even had all copies notarized along with her passport as instructed on April 11th.

She then got a letter back and her passport on April 22 dated April 16. The letter stated that our case was under further review and when review is completed they will contact her by mail to have her submit her passport at the local VFS office at which time they will issue a visa.

As she is due to have our First child in July I got a little worried. I have no children with my pervious wife incase anyone is wondering.

Well I contacted the Delhi office to see what was going on NO HELP. I contacted my congressman's office they did do an inquiry but really NO HELP. I called DOS at 202-663-1225 they told me that the case is still at the embassy and is under review at the embassy not state side. Additional Review officially started April 23 also she verified its not a name check issue, did not say if it a Relationship issue, but what else could it be? Well even though they have not asked for anything else as of yet or asked me to come to the Delhi office I was wondering if I should just go anyway.

I have seen some other posts in the Consular section Forum Where in K-1 situations in mainly Philippines and Vietnam or South American countries the Sponsor was asked to come to a second interview to help prove the Relationship by the embassy. Not so in my case but well since I am going to probably end up going to India anyway do you guys think I should try and schedule something? If so any suggestions on the best way to go about that? I will be dealing with Delhi so any personnel experience would be Highly appreciated general Ideas also very welcome.

Thank you guys and as Always God bless and best wishes

As difficult as it is, I would just wait.

Ok I peronally went to Dhaka, Bangladesh embassy myself. They are very similar to India in quick work (not) and volume of cases. So this is what happened:

In december 2007, after 3 months of AP, I went to bangladesh myself and called the embassy. They said coming in person would not help expediate anything. Ok. I knew that as well but I would kick myself if I went all the way there and did not go to the embassy. They would not let my husband in, as they don't let locals in for no reason, and so I went in their by myself as I had a US Passport.

As I walked through the corridors of the embassy I saw about a hundred faces staring at me as I walked passed to enter US citizen services...it was horribly sad to see so many people, hopeful and waiting and who knows how long each had been waiting.

Anyway I finally got into the room and the lady at the window took about 20 mins to open the window. I finally got up and showed her the 221g paper they gave my husband on day of interview. She didn't look at it as she is familar with it and understood I was in so stress. I explained to here I came all the way from US and spent couple thousand just to come talk to her. She understood but said she could not do anything until the check was cleared and they did their final review (what your wife is in now). I knew it was not helpfule for me to go there IN PERSON but I did and I know at least God helped me do whatever was phsyically possible for the case. Now I will begin writing letters to congressmen because my husband was turned down a second time and his passport was returned in March so its really time to push this case.

Yes I suggest you go into the embassy and talk to USC services and try to get hold of a immigration worker there and see what they can do. Maybe if you explain your wife is pregnant, etc, they will make a note of it and make the case go by faster as it is only review and not related to name checks.

Tammy

AP: Over 1 year.

Visa: Nov 2

US Entry: Nov 13, Alhamdulillah.
