Eligibility on the EAD

I'm at the part where it asks you for the eligibility category you are filing under.

After reading through all the categories, I'm pretty sure it's A 6:

K-1 Nonimmigrant Fiance(e) of U.S. Citizen or

K-2 Dependent--(a)(6). File your EAD application

if you are filing within 90 days from the date of entry.

This EAD cannot be renewed. Any EAD application

other than for a replacement must be based on your

pending application for adjustment under ©(9).

But the example form says C 9, and some searches of this forum unveiled C 9 also. Even the statement above says C 9 at the end.

But my question is, isn't C 9 for the second time you apply for EAD? And A 6 would be the first time you file for EAD?

This is the first time I am applying for the EAD and I am filing it along with the AOS.

Becaue you will be filing the I-765 along with or after filing I-485.

You should NOT use (a 6) because that is the "Temp 90 Day" EAD, that expires 90 days after USA entry, and costs $340 to file.

Just a minor point... I'm sure I have this correct, but thought I would double check.

On the example form of the I-765, "Which USCIS Office?" and "Results (Granted or Denied - attach all documentation)" was left blank. I assume that I leave it blank too?

Yes, you never had an EAD card before so leave it blank.

I'm on OPT now with an EAD card so I had to fill that part out.

You check NO for question 11, the rest has to do with if you checked YES and does not apply so should be left blank.

It's the other way around.

Logically from the above, a replacement EAD as K-1 is (a)(6), other than replacement - (c(9).

Actually just to be ####### about it put N/A (not that it really matters I'm sure). I just never leave things blank on USCIS forms.

I heard of people receiving RFE's for leaving questions blank. Answer all questions, and put N/A or None, where appropriate.
