Can my love stay with me...?

Good morning-

I think I may have posted this question some where else on the site....sorry if I'm being redundant!

I began the K1 process in early april and show one "touch"....my love has a job in Canada that is finishing in late July. May he come to the US and "visit" with me while the Visa is being porcessed...?

He has an address and such in Canada for the paperwork to be sent to...

Yes, he can. But, it also depends on how much documentation he brings as proof of ties to prove that he'll return to Canada. I went to visit my USC fiancee back in february; I brought 3 employer's letters, 3 pay stubs, a letter from my rent, all bills tied with my name on it, and I also brought along any paperwork proving we were going through the K-1 process. In the end, I didn't have to show a piece. But... better safer than sorry.

This is an extremely frequently asked question.

The answer is yes, your fiance may visit you while the visa process is going on. He must show strong ties to Canada though, showing that he will be returning there after the visit.

He will need things like, A letter from his employer stating how long he's on vacation and when he will be back to work, bank statements, visa statements, mortgage or rent agreements, etc. etc.

When he goes across the border he should be perfectly honest.

I stated I was visiting my fiance, they asked a few questions about when we were getting married, how far along in the K1 process we were, etc. etc. and I never had to show one bit of evidence I brought. It's best to have it with him though, cause if they ask and he doesn't have it, well, you can figure it out.

Ok here is my situation. We are still waiting for an interview date and my fiance and I are getting really anxious (we have been together for 4 years long distance and really just want to be together!). I gave my work tentative notice for July 1, 2008 and depending on when I got my interview I would stay longer. Here's my question, lets say I don't get an interview until late July or early August (I am eligible in the system at the consulate so we are just waiting for an interview), can I leave my job July 1 and go down to stay with him until my interview?

I would think that if you actually have the interview date, it would be a pretty compelling piece of evidence that you're going to return to Canada. However, with that being said, I asked he same question of a CBP officer in Toronto and he told me it is up to the individual officer, and he wouldn't be likely to grant it because he's be worried that you'd just adjust status in the US. This seems illogical and irrational for anyone who has done the right thing up until now to do, but that's what he told me.

There's nothing wrong with visiting with him until the interview if you don't intend to make it your actual move. Someone else may say different, but it appears to me that you have every right to "visit."

Thanks for all the replies and information! We are still undecided if that is what I am going to do. We are going to see when the interview is before we decide to do that or not!

Something you may want to add into your considerations . . . if you quit your job to move to the States to get married and join your husband, you are eligible to receive EI benefits even in the States. If you quit but don't move down on a visa to join your husband right after leaving your job, you may not be eligible to receive EI benefits. If money is a consideration in your household you might want to factor this into your decision.
