Hi everybody,

I may sound stupid, but I got an email from USCIS, saying that they need additional evidence.

I got a RFE before which was about I-864...but now there's another one...and I have a feeling it is about the same thing again....

So there must have been a mistake somewhere when we filed it...So I was wondering if anybody could help me fill out the right forms :(

So my husband, who's from here, is still a student and doesn't work. I'm also a full-time student. While he lives at his parents' place, I stay at my brother's, and during the week-end I go to his place.

So we ask his dad and my brother to sponsor us.

- so my brother filled out the I-864 form.

- his dad filled out the I-864 A form.

- but my husband didn't fill out any form at all ...

Are we missing something? Was my husband supposed to fill out something even though he doesn't work??? we are so confused....:(

Any help would be greatly appreciated ...

There is the mistake.

US Citizen spouse MUST sponsor the immigrant, so MUST provide I-864 as primary sponsor.

They can use father and brother, Usualy father will fill out I-864 as Joint sponsor, and can use brother as a member of father's household, and brother will provide an I-864A as such.

Yes, that is the problem. We did the same mistake, we didn't file the I864 from petitioner, but after we replied the RFE everything has a succes outcome.

If his dad lives at the same address as your husband they need to fill out the I864A and notarize it. Your husband and his dad must sign the I864A.

By the other side, every co-sponsor (your spouse, his father and your brother) need to fill out an I864 with the respective financial information and employment letter, paystubs...

If your husband didn't work he can attach a written explanation about it. Also he can attach evidence as school records in order to proof that he was/is a full time student.

And when we first sent the I-864 A and I-864, we sent everything, the tax forms etc..but we didn't give any letter explaining why my husband doesn't work...so like you said, we have to show school records etc...

And I may sound stupid again, but just want to make sure....for notarizing the I-864 A, do we need to see a lawyer for that? ...

None of the I-864 forms need notarization, that includes I-864, I-864EZ, and I-864A.

Some editions of the Form I-864 and Form I-864A include a jurat to be completed by a notary or by a consular or immigration officer to show that the person signed or acknowledged the signing of the Form I-864 or I-864A under oath. The Form I-864 and Form I-864A, however, provide that they are signed “under penalty of perjury.” Thus, 28 USC 1746 (which deals with the legal effect of unsworn statements) makes it unnecessary for Form I-864 and Form I-864A to be signed in the presence of or certified by a notary public or an Immigration or Consular Officer. Note that the jurat has been removed from the January 15, 2006 edition of the Forms I-864 and I-864A. Form I-86EZ is a newer form, and therefore never had the jurat.

Wrong about notarizing, NONE of the I-864 forms require notary.
