Entering the US on VWP though K1 in Passport?!

Timeline

I need to know whether I can enter the US for 5 weeks NOT using the K1 that is in my Passport (valid until mid October) and eneter on the VWP instead since I know I HAVE to come back to Germany and AP is not an option since it would take too long and emergency AP would not be granted since it is not a life and death situation.

Sorry you can't. Once you enter the POE, your K1 is activated and your 90 days start. Thats the whole purpose of the visa.

I'm not sure this is correct...with all due respect. I *think* you can do this if you explain to the POE officer that you are not wanting to use the K-1 at the moment. However, I have to add here that the ones I know of that have done this are Canadian, maybe that's different. I do think I would ask this in the Regional Forum to hopefully get a better answer.

As it says on that thread it's up to the IO at the POE, very risky. She isn't going to know 100% unless she attempts it.

I personally wouldn't recommend on trying it.

Maybe calling the POE will get her an answer but I would think it will be based on the reason why she wants to enter under the VWP. I have read her other thread and she wants to go over because she cant commit herself to moving over at this time plus to sort out her relationship. Will that be enough to enter under the VWP? I don't think so but I could be wrong.

I think what's being pointed out is that to say it's an absolute, is not totally correct. Quite a few Canadians have had success in going to the USA after their interview with their visa, to plan their wedding, or just to visit before they use their visa. As Karen pointed out, maybe it's because the people were from Canada. Border officials have said that it was no problem. Perhaps coming from another area would prohibit this, and as we all know...it's all up to the border officials discretion.

As with almost all Canadian airports, you enter Customs and Border Control at the Canadian airport. If I was turned away, I'd not have incurred any additional cost and could just leave the airport until I did plan on using the K-1 visa. The poster is from so far away, a denial, might mean an unexpected return flight!

I agree with both posters...there is a possiblity, but I personally would never chance it!

If you take a look at Natasha's post http://www.visajourney.com/forums/index.php?showtopic=130786 you will see why she wants to enter. Now I cant talk for other people who have entered under the VWP while they had there K1 but I don't think it's worth the chance for her to attempt to enter.

Maybe someone else from another country rather than Canada can answer this one.
