Fear of AOS denial because of husband's pending deployment

Hey Guys,

I need your advice once again!!.....

Im ajusting from a B2 visa so I know I will be getting an interview but I'm not sure when because I got RFEd so that kinda delay things quite a bit!

my Husband as orders to deploy Aug 1st and Im scared that by the time I get the letter for the interview he won't be here and he will be gone for 15 months long.....I have heard that it is possible to get an approval without the other spouse being there, but I am not sure if its true. So I need some other opinion on this matter because I'm worried that I wont get approve if he's not present!

Is there anyone out there as been through this or going through it??

PLEASE HELP all advices will be deeply appreciated!

It is true, just have all the proper documentation showing your husband's deployment. There is no need of your husband's presence in case he is in the military and out of the country on orders. Anybody out there that has been through this already??

I think you can have your case expedited because of it. I know someone else has been through this.

I don't know about the expedite but I am in the same boat and we have decided that if I have an interview, besides carrying all the documents and his orders. Daniel will arrange for a JAG officer to go with me, just in case.. Although there should be no problem.. I am sure even USCIS understands :P that if a soldier is deployed, he can't be here...

2011 March 31 - Sent off Naturalization pkg overnight to Texas

2011 April 1 - Arrived in Texas at 10:21 am

2011 April 1 - NOA (rec'd via snail mail April 8)

2011 April 7 - Cheque cashed

2011 May 5 - Biometrics (letter rec'd via snail mail April 15)

2011 May 9 - Placed in line for interview scheduling

2011 June 13 - Rec'd yellow letter (no change in status online)

2011 June 23 - Rec'd text that my case has been scheduled for interview

2011 August 1 - Interview (rec'd via snail mail June 27) PASSED

2011 August 3 - Rec'd email that my case has been scheduled for Oath

2011 September 1 - Oath ceremony (rec'd snail mail Aug 5)

2011 September 1 - All done, yeah.

Can't locate it either. But read it a few weeks ago. There are quite a few like us and the USCIS deals with it all the time so still hoping it will not be a problem. Its too late for an expedite anyways (if they do it) coz Daniel leaves for his training for month on friday and then gets deployed..

I hope somebody who is knowledgeable will answer or response here because ill be in the same boat also. After our wedding this coming August, my fiance will be back in Japan and he will leave in the USA. Ill just fixed my AOS, AP, and Japan Visa so i can follow him.

How about Expedite? How can we do that? What are the requirements?

12/xx/2006 - First Date in person

01/xx/2007 - 10 day visit of my BF & Official BF/GF relationship

02/xx/2007 - Applied for Tourist visa for Japan (Approved)

04/xx/2007 - Went to Japan to visit BF

08/xx/2007 & 09/xx/2007 - Another visit and decided to file K1 visa

11/xx/2007 - I129F sent to CSC

12/xx/2007 - Spent another long vacation here in Phil & He proposed to me

Thanks krikit..

I had the same question a couple of months ago and found out that they normally do not expedite AOS as we are already here and the deployment will not cause much hardship.

The USCIS is more likely to expedite the visa process and the naturalisation if the spouse is deployed for a certain amount of time (I am no expert on this).

Correct me if I am wrong (I hope I am but frankly even I don't see extreme hardship for me due to his deployment except the fact that we will be away from each other and I will worry myself to death for his safety). My life here does not change drastically that a GC now or a few months later will make a difference...
