k1 visa denied but passport not returned, will be mailed back

Timeline

We went for an interview at Rio De Janeiro for the Finacee visa. The interviewer was very kind but told us that he did not qualify for the visa and also did not qualify to apply for a waiver. We were given a letter saying he was inadmissable under Section 212(a)(9)©.

Right then and there she returned his original birth certificate and police certificates but did not return his passport. He was called the next day on his phone and asked to pay the money so that his passport would be mailed to him.

Is this normal? Do they keep your passport even when denying you a visa? OR do they only keep your passport when they will be sending you a visa.

It sounds like they forgot to give you back the passport, and now they will mail it to you, at your expense! Sorry about your denial. I don't know why you were denied, and they said you can't submit a waiver?? Is this not news to you? I thought you might be asking for information to get this approved!

- 07/08/2009: Check cashed

- 07/10/2009: Received all 3 NOA1s

- 07/14/2009: Received biometrics appt.

- 07/29/2009: Case transferred to CSC

- 08/01/2009: Advanced Parole Documents Issued

- 08/06/2009: Biometrics appointment completed

- 08/11/2009: EAD issued (received 8/14)

- 11/12/2009: AOS approved

- 11/20/2009: Green Card in hand!

you can fight this denial, do you have or were given any reasons for return.....the thing is u have to work fast to keep the application at the embassy. Get in touch with your state rep and have them check into it, dont just accept it and not at least try to keep it there. Unless you know of a specific reason that can not be fixed.
