I am in the U.S. and i was charged with a Class C misdemeanor and I was arrested for failure to I.D. a few years ago. I was reading the USCIS information for the I-485 and it said i required a criminal history report if I was arrested, but it also said that it was requried for anything above a Class B or A or a felony. Can somebody explain to me if I should get a copy of it and send it in with the packet to the USCIS. I don't think the criminal history report will affect my AOS but I was worried if failed to do so it might show that i tried to hide this information and might get me in trouble that way. If anybody could help me with this matter I would greatly appreciate it

Are you a beneficiary or petitioner?

All beneficiaries are required to present the criminal record from their home coutry at the time of the interview in the US Emgassy abroad. Did you have an interview in your home contry before you arrived to US? Did you have your police record with you from your home country? Did you came on K1/K3 visa?? Let us know. People will be able to help you more if you share your background a bit.

Well first of all let me tell you not to worry. They will see the information and ask you about it in the interview which is why you need to get a Certificate of Disposition detailing the result of the misdemeanor charge (conviction/dismissal etc) and a report of the arrest record (if that's separate and you weren't charged). You'll either get an RFE for it or it'll be brought up in the interview so try getting the documents as soon as possible.

I had a trespassing violation dismissed last year and sent in the Certificate of Disposition for it with the I-485.

I'm assuming all this happened in the US and that you're adjusting status from in the US of course, if that's not the case you'll need to elaborate on your situation more.

You will need to submit a Certificate of Disposition for the misdemeanor, that's all.
