Hi all... Nice to meet you all

My husband is the US citizen and I am British. We have been married for a couple of years and living in the UK, but he recently went back to the US to find work (he just got a job) and a house... So our son and I are planning to join him permanently by July 09.

We have been reading up on all the things that we can find on this site and others about the process... But we have a couple questions:

  1. For the I-130 Package none of the copy's need to be certified?? So he can just photocopy the back and front of his birth certificate and our marriage certificate?
  2. For evidence of a bonafide marriage will the following be enough:
  • Our son's birth certificate
  • Joint Bank accounts/both in the UK and USA (although the US one is new)
  • Phone Bills
  • Emails
  • Affidavits from his mother and father, my mother and a neighbor

Is there anything else?? or should we be getting the affidavits from other people?

Some other good items to show that you are living in a relationship would include co-tenants on a lease or co-owners of a house, co-ownersip of a car

For the 130, you need to show that the applicant is a US citizen. For that you need a copy of your birth cert, or a copy of your US passport--it´s always a good idea to have these things notarized.

For evidence of your marriage, you must send a copy of a marriage certificate, divorce records, 2 color passport photos of each, and the G-325 forms. These are required.

In addition, you should send one or more of these other kinds of evidence: proof of joint ownership of property, a joint lease, a joint bank account, birth cert of children, affidavits (notarized).

I wrote a letter explaining all my evidence; I gave them a timeline in the narrative with the evidence.

VERY IMPORTANT:

Make two copies of everything, plus get the latest forms and look for the fee changes (look at my timeline).

Wedding in Vietnam: 12/25/2005 (graduate school, below poverty line, couldn't apply)
[b]August 27, 2007[/b]: 1st I-130 packet sent w/incorrect $190 instead of new $355 fee (Mesquite, Texas).
October 6, 2007: 2nd I-130 packet with $355 fee (Mesquite, Texas).
January 10, 2008: NOA1 March 31, 2008: NOA2 (approved & sent to NVC)
April 14, 2008: NVC sent AOS Fee Bill (Affidavit of Support) $70.00 & DS-3032 form
Received.
April 15, 2008: Faxed wife the DS-3032 agent form to be mailed from Vietnam.
May 5, 2008: NVC sent request for Affidavit of Support form. May 19. 2008: received NVC's request for Affidavit of Support form.
May 20, 2008: Sent off I-864, Affidavit of Support May 30, 2008: Received IV Fee bill for $400 --money order & sent by Priority Mail.
June 10, 2008: I-864 approved. June 11, 2008: IV fee entered in system. June 16, 2008: DS-230 barcode issued
June 30, 2008: DS-230 mailed by expressed mail July 3, 2008: DS-230 package arrived at NVC & under review
July 11, 2008: Case completed at NVC.
Sept. 5th, 2008: INTERVIEW DATE at HCMC: White paper with writing.
March 26, 2009: Resubmit.

August 2009: filed new I-130. Approved after first I-130 case sent to VN, again.

Absolutely nothing submitted with the petition needs to be notarized. A photocopy of a marriage certificate and birth certificate that bear the seal of the issuing authority will do nicely. Have the originals available at interview in case they want to see them. What you have is just fine. I wouldn't bother with the affidavits unless you already have them. Your son's birth certificate and joint bank accounts will be far more than sufficient.

Notaries witness signatures. If there's a question about your documents, the Consular officer will want to see the originals, not some notary's signature that they saw them.

Facts are cheap...knowing how to use them is precious...
