I am married to a K-1 visa holder. She was out of the US for 3 1/2 years while we went thru the long and painful waiver process for her overstay. We are now filing for AOS. She worked in the US using a false ss for a few years prior to 2005. After she returned to her country in 2004, a letter from SS for her arrived in the mail. It stated that her name didn't match the number beiing used etc. and that was the last I ever heard from them as I never responded in her behalf. I had no idea what to do and forgot all about it, until now.

Will this be a problem when adjusting status or getting a legitimate ss#? Has anyone here faced this or have any knowledge of this? Any info will be appreciated.

No, this was dealt with when you filed a waiver.

You will need to apply for a valid SSN, and should do so shortly after entry on the K-1

On the G-325 it will list her unauthorized work from 2001-2004. On the I-765 for EAD, it asks for ss#s used. I don't want to lie on either of the these forms and I am wondering if it will be opening a can of worms.

Also, when applying for a new ss#, will it show up that her name is with a ss# that is not hers? I am really stressing out about this. The waiver process was miserable and I just want to get this done as painlessly as possible. Thanks for the replies.

Hi how about me. I had applied my SSN february 22,2008 till now no SS card recieve yet. den march 19, 2008 we went to the SSA and the lady SSA officer said they sent it already. But until now no SS card showed-up. But the lady's gave me a printed out of my SSN. it says like this:

OUR RECORDS INDICATE THAT SOCIAL SECURITY NUMBER XXX -XX - XXXX IS ASSIGNED TO ABCD , , , XXXXX

YOUR SOCIAL SECURITY CARD IS THE OFFICAIL VERIFICATION OF YOUR SOCIAL SECURITY NUMBER. THIS PRINTOUT DOES NOT VERIFY YOUR RIGHT TO WORK IN THE UNITED STATES.

But i sent my AOS already with my SSN given by SSA officer.

o5-29-08--SENT THE AOS PACKAGE TO USCIS

o5-31-08--Item was delivered at 5:35 AM in CHICAGO, IL 60680.

o6-04-08--USCIS recieved the AOS and EAD package

o6-10-08--AOS and EAD NOA date

o6-14-08--Recieved a AOS and EAD notice for Biometric on June 24, 2008

o6-24-08--AOS and EAD Biometrics done today! @ 9:00 a.m in West Palm Fl.

o6-24-08--AOS and EAD touch!

o6-25-08--AOS and EAD touch!

o7-08-08--AOS case transfered to CSC

o7-11-08--AOS case pending at CSC

o8-07-08--EAD Card Production Ordered today!CRIS

o8-14-08--AOS touched

o8-15-08--Email from CRIS Welcoming for a new resident in the USA

o8-15-08--Email from CRIS EAD notice approval

o8-15-08--EAD card arrived in the mail, EAD was approved in 70 days.

o8-18-08--Received hard copy of WELCOME LETTER as a new resident in the USA

o8-25-08--GREEN CARD Card Production Ordered

o8-29-08--AOS Approved! without Interview

o9-02-08--Received GREEN CARD with out INTERVIEW, with out RFE.

This is not a problem once a number is assigned it is your's for life, the card is not needed for you to put the number on the AOS paperwork.

The disclaimer is correct, you need EAD or green-card to work, having the SSN by itself is not evidence that you can take a job, the card would have "Valid with DHS auth only" on it.
