EAD Background Check

Hi there,

I have searched the forum, and while I found some helpful information, I am wondering how things worked out for others or if anyone has advice.

So, I too received a generic letter regarding a pending background check for my EAD.

I am in the process for family based AOS. I have been waiting months (like alot of others here).

I do have my GC interview next month, so have figured I would be able to sort out the delay with my EAD when an immigration officer has my file in front of them.

It was my understanding that the EAD is interim while case is pending... so how they can make you wait for background check?

Has anyone else here been able to have their EAD issued after contacting USCIS or a congressman?

Will I be wasting my time by crying to USCIS?

Will I get better answers by discussing this at interview?

I would really like to hear anyone else's experience who has gone through the same thing.

Aww this is a tough one. I have seen it reported here that EAD's have been delayed due to background checks, although it is rare. If you can wait until next month to inquire about it, that's great.

Personally, what I would do is to make an infopass for the same day as your interview - just in case. Depending on what time your interview is and how busy the office is might be helpful to have a separate appointment lined up.

Hi,

I am sorry to hear your EAD is delayed, I feel for you since mine was actually approved but it just got lost in the mail, I don´t have much experience with delays due to background check. In my experience, just like you I had my AOS interview about a month after my EAD didn´t come, I contacted congressman and that didn´t help, I went for Infopass and I was told I had to re-file and pay again the fee for EAD and wait for 90 days... again my situation was different EAD was lost in mail. At my AOS interview the officer was very helpful and she not only approved us on the spot but also stamped my passport with I-551 (temporary green card which allows you to work and travel) while my green card came in the mail. The card came about a week later so no more need to worry about EAD. Once again my situation was different and if you are stuck in background check for EAD most likely you will also have that situation with AOS, BUT you definitely can bring up that situation to the officer at the interview and he/she will give you more information that all you can find through USCIS Call center, Infopass or Congressman.

I hope that helps... be very patient I know how you feel but this is how the process works... =(

03/13/08 - Contacted congresswoman over EAD issue

03/27/08 - AOS Interview Approved I-551 stamped on passport since EAD got lost in the mail

03/27/08 - Applied for SSN

03/31/08 - Approval Notice for I-130 and I-485 in the mail

04/05/08 - Received Green Card in the mail

04/10/08 - Received SS card in the mail

12/27/10 - Remove conditions

Thanks for the replies. yes, it is very frustrating. Just my luck to have the oddball and unusal happen with my case. I think I will call USCIS today and definately discuss at interview.

I will keep you all informed with the outcome.

i'm new at this.. sorry they are giving you such a hard time.. i just wanna tell you to hang in there... .i pray they approve you quickly...

Now after I think about it.... Why would a congressman help me? After all, I am a non-citizen and not allowed to vote. Maybe my husband would have more luck there, since he is a US citizen.

What do you think?

Because you are a resident of his district, and while you may not have elected him, he is still your elected representative and there to help.

Absolutely amazing!! I can't believe it!

So I didn't call USCIS but got an email update today saying EAD card ordered. WOW.

I wonder if they are trying to get our hearts to skip beats?
