I have a friend who had a B1/B2 visa. Unfortunately ( I told her not to do it), she worked on that visa each time for 6 month intervals. She did that for 3 years….worked for 6 months in the US then came back to Jamaica for 4-6 months. A few years ago she was stopped my immigration because they said she was working illegally and was banned for a couple of years. She recently married a US citizen and submitted her 1-130. Will the recent ban pose a problem for her at the interview? If so….what does she need to do to rectify this issue?

How many years was she banned? If her ban is still "active" by the time her interview comes around, then her visa will be denied. She will have to file the I-601 waiver. Point her to the Waivers forum here and to www.immigrate2us.net.

08/17/08: Mailed N400 to TSC

08/19/08: USPS attempted delivery

08/20/08: TSC received N400

08/21/08: TSC cashed check

09/02/08: Received NOA...........Priority date: 08/20/08

..............................................Notice date : 08/22/08

09/02/08: Received Biometrics Notification

09/18/08: Biometrics completed - Charlotte DO

10/24/08: Received Interview Letter

12/08/08: Interview @ 1:00pm. APPROVED!

01/05/09: Oath Ceremony 10:00AM. Now officially a USC!!!

I think it was a 3 year ban. I dont think it is active.

How did the border agent know about the illegal working?

The border noticed that she was coming in the US alot....and just said that she must be working there illegally (no proof)...and sent her back on the next flight.

So they didnt have any real proof? Does she have an "official" ban, or was she just denied POE that one time. Sounds like she may be ok, but I'm sure it will come up at the interview. Immigration is perfectly fine with taking your money and making you waste all your time to tell you something that could deny you at the very end. If it happened awhile ago she should be fine. I would just have her prepare for the question.

I agree. Only one of my friends were questioned at their interview. Unless the rules changed since the late 90s, I've know of several people who did the same and was filed for my a USC and had no problems. They were stopped and sent back to Jamaica the next day. In one of the cases, he had paystubs in his carryon...yes, he gets the DA certificate of the day.
