Hello everyone!!

i've been reading threads on this website and i see all people are talking about financial situation ans co-sponsors.do you have to make a certain amount of money???our lawyer nevertold us anything about it so i'm just worried...thank you in advance..

The petitioner has to be earning above the 125% poverty line.

I see your point but personally... I feel that the petitioner worrying is enough reason and that a couple should be well informed of the details before proceeding. You pay these people a great deal of money to handle things for you so leaving out certain things is understandable but ultimately the excuse that 'my lawyer never told me that' means nothing to the government when it comes down to it. Maybe the petitioner wants to quit his/her job and doesn't realize there will be reprecussions as far as the visa is concerned....etc. Regardless of opinion, it's an important detail to simply leave out because you know it's not a problem months before it's required.

When you hire and advisor it is NOT a one way communication street. My tax preparer does not tell me all the ins and the outs of the IRS code. I am informed when I have a problem that needs my attention. In addition, I consult when I am about to make a major life choice to determine tax consequences. You cannot put the sole burden on the hired advisor.

point taken and I would agree on a personal level. Same holds true for doctor's.... ;) It is your responsibilty to educate yourself and not enough people do... however...

That being said. The affidavit of support is a main requirement of the petition and it is MY OPINION that if you hire legal cousel to handle your K1 you should most definately be informed of this requirement upon consultation. As you previously stated, you hire a lawyer to 'handle the details'. This is not some small detail that you should have to just find out on your own when you're paying for the service of a lawyer.

As I said, this is just my opinion and I'm happy enough to agree to disagree. ;)

Hey, if you don't meet the 125% above poverty level thing for the sponsorship, then you can have a joint sponsor that can make the 125% for their houseshold that can joint sponsor for you two. For my husband and I, my dad is going to joint sponsor with me. There are a couple ways it can be done. You can combine the income of all the household members and have them be you cosponsor with the I864A. Or you can do a joint sponsor from a different houseshold and they have to make the 125% for their household and they would use the I864 just like you will. But if you have a lawyer, they can tell you all the ins and outs of this... Good luck!
