Affidavit and supporting documents

Hi....

I am the beneficiary, and my finance (petitioner) and I are still waiting for our NOA2 from the CSC. I am from England, and will be having my interview (I presume) at the embassy in London.

As we wait, we are preparing all the forms and documents we will be needing for the affidavit... I have a few questions and concerns...

My fiance does not have a bank account, and therefor will not be able to show a letter or balance. (He is not able to open one just yet, due to bad history). He cashes all his work checks at money tree, would these receipts be ok? Everything else is fine, such as income and employer letter.

As we are worried about the bank account issue, we are using his dad as a co-sponsor. There are no problems there, except that we feel he may have done everything too early..... is there a certain amount of time that the affidavit is valid for? I read somewhere that they wont accept one that is more than 3 months old.

Will it be ok that he does not have a bank account, when we have a suitable co sponsor?

This is the exact wording from the London Embassy Packet 3 which has an updated date of April 2008, so it's the latest version. We got it from London last Thursday.

Evidence of Support (skipping the first part because too much to type) Please note that this evidence must be less than one year old when presented at your view interview.

(I think that word view is an embassy typo. It doesn't make sense.)

and on page 8 under Affidavit of Support

To substantiate the the information regarding income and resources the sponsor should attach two or more of the following items to the affidavit.

  • notarized copies of his or her latest federal income tax return;
  • a statement from his or her employer showing salary and the length and permanency of employment;
  • a statement from an officer of a bank regarding his or her account, the date the account was opened and the present balance;
  • any other evidence adequate to establish financial ability to carry out his or her undertaking toward the applicant for what might be an indefinite period of time.
(He ought to be able to do tax return and letter from employer. It says two are needed. Pay stubs would be other evidence.)

Also on page 8 (this would be a note on the dad's co-sponsorship)

If the sponsor is married, the affidavit should be signed jointly by both husband and wife.

A Bank statement is not needed if he is making enough money (125% of poverty line) - so his tax return and letter from employer would be enough with the I134 - leave the asset info blank. Good Luck

I was wondering, how one goes about having their tax return notarized. I do my taxes on Turbo Tax and file electronically (I print out a copy for myself though...and that's what I gave my fiance to take back to England with him.) What exactly is getting notarized? A signature? If so, can a notary public just notarize copies that I've printed off from home? This is the one form that's given me the most aggravation! :angry: Any help would be much appreciated...

2009-03-20 : Lee arrives in the U.S. on his K-1 Visa

Notarizing a tax return is not necessary no matter what the instructions say. They would actually prefer a tax transcript from the IRS. You an order them online an have them in a week or call and have them faxed, free.

Facts are cheap...knowing how to use them is precious...

Notarizing a tax return is not needed. And I always just send copies form my turbo tax and it has always been OK (no signatures as I also file electronically) - just be sure to attach W-2s or 1099s if applicable. I never ever thought it worthwhile to get IRS transcripts but many people like that - it's your choice. Good Luck

Notarizing a tax return is not needed.
