Please Help!!!!

Ientered the U.S in 2005 and stayed until 2008 I managed to extend my visas 5 times and on the 6th time was denied.I then left the country and returned to England.When I tried to re-enter the U.S two weeks later I was denied entry because I was not eligible for the visa wavier.

While I was in America I stayed with family and had my own income from the U.K so I was never a burden on the state.My fiance and I met two years ago and have a loving relation and would like to be together.We have now had to conflicting advise from two different attourneys, one says to apply for the K1 another advises the K3 because of my extensions.

My fiancee is a U.S citizen and I am a U.K citizen. Can anyone advise!!!!!!!!!!

K-1 is the quickest and should not be a problem, you did not overstay your visa, and being denied entry by POE wont affect the K-1 petition.

If you are considering K-3, then I would advise just doing CR-1. CR-1 is an immigrant visa that is work authorized and gets green-card upon entry, does not need to adjust status ($1010) and can get SSN and apply for a driver's license. K-3 is NOT work auth, so cannot get SSN, apply for driver's license, or take a JOB, until they have EAD or green-card.

CR-1 is not much longer than K-3 for UK, compare timelines.
