Will this be a problem?

My fiancee' and I will be married soon if we get through all this paperwork in Vietnam. She was denied for a K-1 fiancee visa 5 years ago for lack of proof of relationship. Will this be a problem down the road for us since we are filing a K-3 anyway? I know we have to check yes for many things on the forms. Applied for before, denied before, etc.

I know we need build a much stronger case and lots more evidence.

But has anyone overcome this problem before?

I'm sure there have been cases similar to yours. From what I understand you have done exactly what many have been advised to do when their K-1 has been denied. You have 5 years behind you now. Get your case in order and think positive!

Are you planning to be their at the interview? I am not sure if they allow the USc in with the fiance or not, check that out. In such cases some consulates have asked to speak to the USC fiance and then approved the visa - I assume they are making sure the relationship is genuine. SO, be prepared for something similar. A K-3 is not an automatic approval. A lot of people on here think that being married is the best evidence. In truth, it can be faked just as easily.

Get all your ducks in a row and you should be just fine. I'd probably suggest you go to the interview, as well, just because of the previous denial.

Jomo's girl is right marriage is not an automatic visa. Even with bunch of Bonafides you're still at the mercy of a CO, that might be in a bad mood that day.

HCM Consulate does not allow the SO to attend the interview.

Ours was returned in June and also expired in June, i have email from them saying we were free to refile, so we married in Nov and now filing cr1 but there are not guaranties with any of this

Wait, was the K-1 denial between you and her or was she engaged to another individual? Because you said "she" was denied, not "we". So I guess she was with someone else at that time.

I think that if she was engaged to another individual, you should definitely have A LOT of back up and probably also attend the interview.

True a marriage is not guaranteed approval, but once a the possibility of a K-1 Visa has been exhausted, then most follow the marriage route. What choice do you have?

HCMC doesn't allow the Sponsor to attend but being in Country sure as hell doesn't hurt. I plan on giving my wife my Passport to present to the C/O with hers. That let's them know you are there. My cousin was actually required to attend his wife's interview in HCMC though. There's just no telling with this Consulate.
